Abstract

Kejahatan transnasional adalah tindak kejahatan yang dilakukan oleh pelaku yang melampaui batas lintas negara. Kejahatan transnasional semakin mengalami perkembangan di era globalisasi dan bukan sesuatu hal yang baru dalam dunia internasional. Salah satu pelaku kejahatan transnasional yang melakukan pelarian melintasi batas negara adalah Maria Pauline Lumowa (MPL) dalam kasus Letter of Credit fiktif Bank BNI pada tahun 2003 yang merugikan negara Indonesia sebesar Rp 1,7 triliun. Upaya Indonesia untuk menangkap pelaku kejahatan transnasional adalah dengan jalur ekstradisi. Dengan melibatkan NCB-INTERPOL Indonesia selaku instansi yang bergerak di bidang keamanan internasional akan membantu memudahkan pencarian atau pelacakan keberadaan MPL. Namun, terdapat hambatan dalam upaya ekstradisi tersebut, dimana sempat terjadi penolakan ekstradisi yang dilakukan oleh Belanda. Penelitian ini bertujuan untuk menjelaskan mengapa penyelesaian kasus ini melalui proses dan waktu yang sangat panjang serta faktor yang membuat Belanda menolak ekstradisi MPL. Metode penelitian ini menggunakan metode kualitatif untuk menjelaskan hambatan dan upaya yang dilalui oleh Indonesia dalam mengekstradisi MPL. Data yang disajikan dalam penelitian ini diperoleh dari berbagai data sekunder melalui studi kepustakaan dan beberapa data primer yang didapat melalui wawancara dengan sejumlah narasumber yang berkaitan dengan topik penelitian ini. Data yang diperoleh akan dianalisis berdasarkan teknik analisis historis dan deskriptif. Berdasarkan hasil dari penelitian yang dilakukan, penolakan ekstradisi oleh Belanda dilakukan karena tidak terdapat perjanjian ekstradisi dan sebagai bentuk perlindungan Belanda terhadap warga negaranya, karena pelaku berkewarganegaraan Belanda. Pada tahun 2019, MPL berhasil diekstradisi dengan jalur diplomasi antara pemerintah Indonesia dan Serbia, meskipun tidak terdapat perjanjian ekstradisi. Hal demikian dapat terjadi sebab adanya hubungan baik yang terjalin antara Indonesia dan Serbia./ Transnational crime is a crime committed by perpetrators who cross national boundaries. Transnational crime is increasingly developing in the era of globalization and is not something new in the international world. One of the transnational criminals who fled across national borders was Maria Pauline Lumowa (MPL) in the case of Bank BNI's fictitious Letter of Credit (L/C) in 2003 which cost Indonesia Rp 1.7 trillion. Indonesia's efforts to arrest transnational criminals are through extradition. By involving NCB-INTERPOL Indonesia as an agency engaged in international security will help facilitate the search or tracking of MPL's whereabouts. However, there were obstacles in the extradition effort, where there was a rejection of extradition by the Dutch. This study aims to explain why the settlement of this case went through a very long process and time and the factors that made the Netherlands refuse the extradition of the MPL. This research method uses a qualitative method to explain the obstacles and efforts that have been passed by Indonesia in extraditioning the MPL. The data presented in this study was obtained from various secondary data through literature study and some primary data obtained through interviews with a number of sources related to the topic of this research. The data obtained will be analyzed based on historical and descriptive analysis techniques. Based on the results of the research conducted, the refusal of extradition by the Netherlands was carried out because there was no extradition treaty and as a form of Dutch protection for its citizens, because the perpetrator was a Dutch citizen. In 2019, MPL was successfully extradited through diplomacy between the governments of Indonesia and Serbia, although there was no extradition treaty. This can happen because of the good relations that exist between Indonesia and Serbia.
