Abstract

Notaris memiliki wewenang untuk membuat akta otentik sebagaimana yang diatur dalam Pasal 1 angka 1 Undang-Undang Jabatan Notaris , dalam peresmian akta harus di saksikan oleh para penghadap dan juga para saksi yang ikut membantu dan kehadirannya sesuai dengan aturan Undang-Undang yang ada. Namun dalam menjalankan jabatannya selaku Pejabat Umum, Notaris tidak jarang terdapat permasalahan hukum sehingga dibutuhkan salah satu alat bukti yaitu kehadiran karyawan yang menjabat sebagai saksi instrumenter untuk memberikan keterangan di pengadilan . Dari latar belakang tersebut maka muncul permasalahan, Bagaimana tanggung jawab saksi instrumenter dalam proses pembuatan akta otentik notaris, dan Bagaimana perlindungan hukum yang dimiliki oleh saksi instrumenter dalam memberikan keterangan di pengadilan. Dalam penelitian ini penulis menggunakan metode penelitian terhadap peristiwa hukum. Tanggung jawab saksi instrumenter dalam menjalankan jabatannya yaitu melihat kehadiran para penghadap, mendengar dengan baik pembacaan akta oleh Notaris dan menyaksikan para pihak menandatangani akta otentik yang telah dibuat dan saksi tidak bertanggung jawab terhadap isi akta apabila menimbulkan permasalahan hukum dikarenakan isi akta tetap menjadi tanggung jawab dari Notaris yang membuat akta otentik itu sendiri. Kemudian perlindungan hukum terhadap saksi instrumenter belum mendapatkan perhatian yang khusus di dalam UUJN, akan tetapi dapat dilihat berdasarkan ketentuan-ketentuan dalam Undang-undang Nomor 31 Tahun 2014 Tentang Perubahan Atas Undang- undang Nomor 13 Tahun 2006 Tentang Perlindungan Saksi dan Korban yang menyatakan perlindungan tersebut dapat diaplikasikan kepada kedudukan karyawan Notaris sebagai saksi instrumenter dikarenakan Undang-undang tersebut bersifat menyeluruh untuk seluruh saksi yang dipanggil dalam suatu proses perkara di pengadilan. / The Notary has the authority to make an authentic deed as stipulated in Article 1 number 1 of the Notary Office Law, in the inauguration of the deed must be witnessed by the witnesses and also the witnesses who assisted and his presence in accordance with the rules of existing Law. However, in carrying out his position as a Public Official, Notary is not uncommon there are legal issues so that one of the tools of evidence is needed, namely the presence of employees who serve as instrumental witnesses to give evidence in court. From this background then arises the problem, How is the responsibility of the instrumental witness in the process of making an authentic notarial deed, and How is the legal protection possessed by the instrumental witness in giving evidence in court. In this study, the author uses the method of legal events. The responsibility of the instrumental witness in carrying out his office is to see the presence of the witnesses, listen carefully to the reading of the deed by the Notary and witness the parties sign the authentic deed that has been made and the witness is not responsible for the contents of the deed if it causes legal problems because the contents of the deed remain the responsibility of The notary who makes the authentic deed itself. Then the legal protection of instrumental witnesses has not received special attention in the UUJN, but can be seen based on the provisions in Law Number 31 of 2014 on Amendments to Law Number 13 of 2006 on the Protection of Witnesses and Victims stating the protection can be applied to the position of Notary employees as instrumental witnesses because the Law is comprehensive for all witnesses called in a case process in court.
