Abstract

Review Notaris berdasarkan undang-undang yang berlaku adalah seorang pejabat umum yang memiliki hubungan langsung dengan masyarakat, yang berwenang untuk membuat akta dalam bentuk autentik, dan melakukan penanganan terhadap kepentingan-kepentingan hukum mayarakat luas, dimana berdasarkan kehendak para pihak dan berdasarkan hukum yang berlaku diharuskan dibuat dalam bentuk akta. Maka dari itu, seringkali menyebabkan seorang Notaris dengan sengaja ataupun tidak sengaja, atau bukan karena dengan kesadarannya melakukan pelanggaran, yang pada akhirnya menyebabkan Notaris tersebut terkena sanksi administratif, bahkan terdapat kasus yang menyebabkan Notaris diberhentikan dengan tidak hormat. Namun ketika telah dinyatakan diberhentikan secara tidak hormat, tidak semua Notaris yang menerima keputusan Kementerian Hukum dan Hak Asasi Manusia tersebut, sehingga hal tersebut mendorong Notaris tersebut melakukan banding ke Pengadilan Tata Usaha Negara. Salah satu hal yang mendorong adalah hilangnya mata pencaharian utamanya karena tidak lagi berprofesi sebagai Notaris, yang kemudian hari dapat menyebabkan terjadinya gangguan stabilitas ekonomi, selain itu Notaris juga dapat mengalami kerugian psikologis dan tentunya menyebabkan nama baik Notaris yang selama ini telah dibangun menjadi rusak dan memiliki reputasi yang tidak baik di mata masyarakat. Namun pada nyatanya dalam Undang-Undang Jabatan Notaris itu sendiri belum mengatur secara jelas dan khusus mengenai perlindungan hukum bagi Notaris selama Notaris menjalankan tugas dan fungsinya. Sehingga peneliti berpendapat perlu adanya pengaturan terkait pemulihan nama baik, dimana sebelumnya peneliti melakukan penelitian terkait hal tersebut, dengan mengolah dan menggunakan sumber-sumber tertulis, baik buku-buku, artikel, perundang-undangan, dan juga wawancara para praktisi dibidang kenotariatan. Sehingga peneliti mengharapkan bahwa dikemudian hari Undang-Undang Jabatan Notaris dapat diamandemen dengan penambahan bab ataupun pasal tersendiri mengenai pemulihan nama baik bagi Notaris. / A notary under applicable law is a public official who has a direct relationship with the community, who is authorized to make an authentic deed, and to handle the legal interests of the wider community, which based on the will of the parties and based on applicable law are required to be made. in the form of a deed. Therefore, it often causes a Notary to intentionally or unintentionally, or not because he consciously commits a violation, which in the end causes the Notary to be subject to administrative sanctions, there are even cases where the Notary is dishonorably dismissed. However, when it has been declared dishonorably dismissed, not all Notaries accept the decision of the Ministry of Law and Human Rights, so that it encourages the Notary to appeal to the State Administrative Court. One of the things that encourage is the loss of his main livelihood because he is no longer a Notary, which in the future can cause disruption of economic stability, besides that Notaries can also experience psychological losses and of course cause the good name of the Notary that has been built so far to be damaged and have bad reputation in the eyes of the public. However, in fact, the Notary Position Act itself does not clearly and specifically regulate legal protection for Notaries as long as the Notary carries out his duties and functions. So that the researcher believes that there is a need for arrangements related to the restoration of good name, where previously researchers conducted research related to this, by processing and using written sources, both books, articles, legislation, and also interviews with practitioners in the notary field. So that researchers hope that in the future the Notary Position Act can be amended by adding a separate chapter or article regarding the restoration of the good name of a Notary.
