Abstract

Penelitian bertujuan mengamati asas pemisahan horizontal melandasi hukum tanah dalam UUPA, ketentuan hak tanggungan, bagaimana lembaga perbankan menerapkannya ataukah lembaga perbankan menerapkan sistem perlekatan menerima jaminan kredit, dengan demikian tujuan penelitian untuk mengetahui, memahami asas pemisahan horizontal dalam pengaturan hukum tanah yang dianut dalam UUPA, terhadap benda dan lembaga hak tanggungan. Penelitian dilakukan di Kota Makassar dengan fokus pada lembaga perbankan, Notaris/PPAT. Ini dilakukan dalam menunjang pelaksanaan pembangunan, melalui lembaga perbankan memegang peranan, pemberian kredit kadang terbentur pada jaminan. Metode analisis data dalam penelitian ini adalah metode analisis yuridis normatif/empirik, dan menggunakan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan kreditur penerima hak tanggungan dalam menerapkan asas pemisahan horizontal terhadap jaminan masih mengalami berbagai kendala, debitur mengalami kendala dalam membuktikan hak atas benda yang berada di atas tanah. Akhirnya penelitian ini merekomendasikan dibentuk suatu lembaga yang mengatur pendaftaran benda-benda yang berada di atas tanah sekaligus dibentuk lembaga untuk mendaftar dan memberikan tanda bukti kepemilikan atas benda, sehingga kreditur merasa terlindungi dan dapat mengamankan dana. / The purpose of this study is to determine whether the principle of horizontal separation underpins the law of land in the UUPA, the provisions of mortgage rights, how banking institutions apply it, or whether banking institutions use the attachment system to receive credit guarantees. The study was conducted in Makassar City, with a focus on banking institutions and Notaries/PPAT. This is done to aid in the implementation of development, in which banking institutions play a role, with lending sometimes colliding with guarantees. This study's data analysis method is normative/empirical juridical analysis, with a statutory and conceptual approach. According to the study's findings, creditors receiving mortgages who apply the principle of horizontal separation of guarantees still face a number of challenges, while debtors face difficulties proving ownership of tangible property. Finally, the study suggests the establishment of an institution that regulates the registration of objects located on land, as well as an institution that registers and provides proof of ownership of objects, so that creditors feel protected and can secure funds.
