Abstract

Penandatanganan sepihak pada minuta akta notarial yang isinya kosong menjadi polemik pada praktik kasus No. 3306 K/Pdt/2018. Pasalnya, terdapat pihak yang dirugikan akibat penandatanganan minuta akta notarial yang isinya kosong tersebut, dan setelah menerima salinan akta ternyata apa yang diperjanjikan dalam akta tersebut berbeda dengan apa yang menjadi tujuan utamanya. Menitikberatkan kepada kewajiban-kewajiban yang harus dilaksanakan oleh seorang notaris, penandatanganan minuta akta notaris yang isinya kosong bisa saja menjadi celah hukum bagi notaris-notaris yang tidak taat prosedur sesuai dengan kewajiban yang telah diatur dalam Pasal 16 Undang-undang nomor 2 tahun 2014 tentang Jabatan Notaris. Penandatanganan sepihak pada minuta akta notarial yang isinya kosong dapat memunculkan suatu potensi cacat hukum bagi dan berdampak pada notaris serta kedua belah pihak. Penulis mengulas menggunakan teori pendekatan kasus dari salah satu jenis metode penelitian hukum normatif dan menemukan bahwa terdapat celah hukum yang menjadikan penandatanganan sepihak notaris yang isinya masih kosong menyebabkan cacat hukum dari pelaksanaan kewajiban seorang notaris. / The unilateral signing of the blank minutes of the notarial deed has become a polemic that encountered daily practices of notaries. The main cause is there is a party who harmed due to the signing blank forms on the minutes of notarial deed. Focusing on the obligations that must be carried out by a notary, signing blank minutes of the deed can be a legal loophole for notaries who do not comply with the procedures in accordance with the obligations stipulated in Article 16 of Law number 2 of 2014 about Notary’s Office. The unilateral signing of the blank minutes of the notarial deed could cause a potential legal defect for and impact the notary and both parties. The author reviews using a case approach theory from one type of normative legal research method and finds that there are legal loopholes that make unilateral signing of a notary blank form a legal defect from the implementation of a notary's obligations.
