Abstract

Penelitian ini mengkaji mengenai homologasi dalam Kepailitan pasca kreditur menolak rencana perdamaian dalam Penundaan Kewajiban Pembayaran Utang (PKPU). Dalam praktik, tidak lazim pengajuan rencana perdamaian dalam Kepailitan pasca tidak tercapainya perdamaian dalam PKPU, namun dalam perkara pada Putusan Nomor 180/Pdt.Sus-PKPU/2019/PN.Niaga.Jkt.Pst terjadi pengajuan rencana perdamaian dalam Kepailitan pasca kreditur menolak rencana perdamaian dalam PKPU, yang mana dalam Kepailitan itu terjadi kesepakatan atas rencana perdamaian dan disahkan (homologasi) oleh Majelis Hakim. Rumusan Masalah dalam Penelitian adalah, Bagaimana pengaturan homologasi dalam Kepailitan pasca kreditur menolak rencana perdamaian dalam PKPU? Bagaimana Putusan Majelis Hakim dalam Perkara Nomor 180/Pdt.Sus-PKPU/2019/PN.Niaga.Jkt.Pst. tentang Permohonan Penundaan Kewajiban Pembayaran Utang yang diajukan PT Sarana Cipta Konstrindo terhadap PT Tinindo Inter Nusa? Penelitian ini menggunakan bentuk dan pendekatan yuridis normatif, dan jenis data yang digunakan adalah Data Sekunder dengan cara perolehan studi kepustakaan. Hasil Penelitian menunjukkan, tiada pengaturan yang secara khusus yang memberikan hak kepada debitur untuk mengajukan rencana perdamaian dalam kepailitan pasca kreditur menolak rencana perdamaian dalam PKPU. Namun demikian, tiada pula larangan terhadap Debitur PKPU jika kembali mengajukan rencana perdamaian dalam Kepailitan. Sehingga pada Perkara Nomor 180/Pdt.Sus-PKPU/2019/PN.Niaga.Jkt.Pst. Debitur PKPU menggunakan Pasal 290 UU 37/2004 sebagai dasar pengajuan rencana perdamaian dalam Kepailitan, dan setelah disepakati rencana perdamaian tersebut, Majelis Hakim mengisi kekosongan hukum dalam mengesahkan kesepakatan perdamaian dengan konstruksi hukum argumentum a contrario terhadap Pasal 292. Namun demikian, secara historis dalam Hukum Kepailitan di Indonesia, Debitur PKPU hanya boleh mengajukan satu kali rencana perdamaian./ This study examines obligations regarding homologation in Bankruptcy after creditors reject the reconciliation plan in Suspension of Debt Payments (PKPU). In practice, it is not uncommon to propose a reconciliation plan in Bankruptcy after the failure to achieve reconciliation in the PKPU, but in the case of Verdict Number 180/Pdt.Sus-PKPU/2019/PN.Niaga.Jkt.Pst there was a proposal for a reconciliation plan in Bankruptcy after the creditor rejected the reconciliation plan in the PKPU, which in the Bankruptcy there was an agreement on the reconciliation plan and it was ratified (homologation) by the Panel of Judges. The formulation of the problem in this research are How is homologation arrangement in Bankruptcy after creditors reject the peace plan in PKPU? How is the Judge's Decision in Case Number 180/Pdt.Sus-PKPU/2019/PN.Niaga.Jkt.Pst. regarding the Request for Suspension of Debt Payment Obligations submitted by PT Sarana Cipta Konstrindo against PT Tinindo Inter Nusa? This study uses a normative juridical form and approach, and the type of data used is secondary data by obtaining a literature study. The results of the study show that there is no arrangement that specifically gives the debtor the right to submit a reconciliation plan in bankruptcy after the creditor rejects the reconciliation plan in PKPU. However, there is also no prohibition against PKPU Debtors if in Bankruptcy they must submit a reconciliation plan. So, in Case Verdict Number 180/Pdt.Sus-PKPU/2019/PN.Niaga.Jkt.Pst. PKPU debtors used Article 290 of Law 37/2004 as the basis for submitting a peace plan in Bankruptcy, and after the reconciliation plan was agreed upon, the Panel of Judges filled the legal blank in terms of ratifying the peace agreement with the construction of an argumentum a contrario Article 292. Indonesia, PKPU debtors may only submit a reconciliation plan at once.
