Abstract

Mengingat tidak semua orang bisa membeli kendaraan secara tunai maka hadir jasa pembiayaan kendaraan dengan menggunakan pengikatan jaminan fidusia yang dibuatkan akta oleh notaris. Pelaksanaan pembuatan akta jaminan fidusia ini dalam praktik timbul permasalahan saat terjadi pengakuan bahwa terjadi penjualan kendaraan yang menjadi obyek jaminan fidusia, dengan bukti kwitansi pelunasan, namun belum terjadi perubahan (balik nama) BPKB. Akan tetapi Notaris tetap melanjutkan pembuatan akta jaminan fidusia dan pendaftarannya meskipun Pemberi Fidusia berbeda nama dengan yang tertuang dalam BPKB. Oleh karenanya masalah dalam penelitian ini adalah terkait keabsahan dari akta jaminan fidusia atas kendaraan bermotor yang dibuat berdasarkan Pemberi Fidusia yang berbeda nama dengan BPKB, dan perlindungan hukum bagi Notaris dalam kondisi tersebut. Penelitian ini, pengumpulan data dilakukan dengan menggunakan metode yuridis normatif. Melalui data sekunder, penelitian ini mengkaji pengertian dari Pemberi Fidusia, dan bentuk kepemilikan dari kendaraan bermotor, serta perlindungan hukum yang sepatutnya diberikan kepada Notaris dalam suatu perkara dimana Notaris tersebut beritikad baik dalam pembuatan akta otentiknya. / Considering that not everyone afford to buy a vehicle in cash, there are financing services using a fiduciary guarantee which such guarantee agreement are made by a notary deed. The implementation of this fiduciary guarantee deed, in practice, rose some problems such as in terms of a vehicle is said to be soled and will become an object of a fiduciary guarantee, in practice the terms only to provide payment receipt of the vehicle sales, without a change (transfer of name) in such BPKB. However, the Notary continues to make the fiduciary guarantee deed and its registration even though the Fiduciary Giver has a different name from that stated in the BPKB. Therefore, the problem in this study is related to the validity of the fiduciary guarantee deed on vehicles that published based on the debtor condition that has a different name from the BPKB, and legal protection for notaries in such conditions. In this study, data collection was carried out using normative juridical methods. Through secondary data, this study examines the meaning of the fiduciary giver, and the form of ownership of a motor vehicle, as well as the legal protection that should be given to a notary in a case where the notary has good intentions in making the authentic deed.
