Abstract

Dalam melaksanakan tugasnya sebagai pejabat pembuat akta autentik, kewenangan dari Notaris tertera dan tercantum di dalam pasal 15 ayat (2) UUJN. Profesi notaris merupakan pejabat umum dalam menjalankan tugasnya terikat dengan peraturan undang-undang dan kode etik profesi. Menurut Pasal 1 ayat (1) Undang-undang Nomor 30 Tahun 2004 Jo, dan Undang-undang Nomor 2 Tahun 2014 yang menyatakan Notaris sebagai pejabat umum, menyebutkan bahwa tugas pokok dari seorang Notaris adalah membuat akta-akta autentik. Walapun notaris adalah profesi mulia yang mulia dan mengemban langsung kewenangan dari negara tidak sedikit oknum-oknum notaris nakal yang melanggar kode etik profesi notaris dan undang- undang lainnya seperti pada contoh kasus yang dimasukan oleh penulis mengenai tindak pemalsuan akta yang dilakukan oleh notaris Meliani Ramawati yang terbukti dalam putusan PT Banten 9/PID/2019 melawan hukum yang dengan sengaja memalsukan akta autentik. Metode pendekatan yang digunakan oleh penulis dalam peenilitian ini adalah metode pendekatan yuridis normatif yaitu pendekatan yang berusaha mensinkronisasikan ketentuan-ketentuan hukum yang berlaku dalam pertanggungjawaban seorang notaris terhadap aturan-aturan atau peraturan- peraturan hukum lainnya dengan kaitannya dalam penerapan peraturan-peraturan hukum itu pada prakteknya di lapangan. Dalam hal ini penulis lebih menekankan dalam Pasal 16 ayat (1) huruf A Tahun 2014 tentang Undang-undang Jabatan Notaris dan Kode Etik Notaris. Dalam pembuatan akta autentik notaris harus bertanggungjawab atas akta yang dibuatnya, tanggung jawab seorang Notaris dalam hal terjadinya pemalsuan akta autentik antara lain diberhentikan sementara, atau pemberhetian secara tidak terhormat dan dimintai peenggantian formil dan materiil menurut ketentuan KUHPer dan KUHP./ In carrying out his duties as an official making authentic deeds, the authority of a Notary is stated and stated in Article 15 paragraph (2) of the UUJN. The notary profession is a public official who in carrying out his duties is bound by the laws and regulations and the professional code of ethics. According to Article 1 paragraph (1) of Law Number 30 of 2004 Jo, and Law Number 2 of 2014 which states that a Notary is a public official, it is stated that the main task of a Notary is to make authentic deeds. Even though a notary is a noble profession that is noble and carries direct authority from the state, there are not a few rogue notaries who violate the code of ethics of the notary profession and other laws, as in the example of the case submitted by the author regarding the act of forging a deed committed by a notary Meliani Ramawati who proven in the decision of PT Banten 9/PID/2019 against the law by deliberately falsifying an authentic deed. The approach method used by the author in this research is a normative juridical approach, which is an approach that seeks to synchronize the applicable legal provisions in the accountability of a notary to other legal rules or regulations in relation to the application of these legal regulations in practice. in the field. In this case, the author places more emphasis on Article 16 paragraph (1) letter A of 2014 concerning the Law on Notary Positions and the Notary Code of Ethics. In making an authentic deed, a notary must be responsible for the deed he made, the responsibilities of a notary in the event of forgery of an authentic deed include being temporarily dismissed, or dismissed dishonorably and asked for a formal and material replacement according to the provisions of the Criminal Code and the Criminal Code.
