Abstract

Transfer of ownership rights to land can occur due to legal actions and legal events. In this study, the main problem is legal protection for holders of land transfer rights issued by PPAT (Land Deed Making Officer) without the presence of one of the parties in terms of decision number 53/Pid.B/2017/PN.End and how are legal considerations and the decision of the case number 53/Pid.B/2017/PN.End. This research is a juridical-normative research that uses library data, legislation and a case approach in research. The results of the research are that the transfer of land issued by PPAT without the presence of one of the parties, in the form of the invalidity of the deed of grant, so that the holder of the land rights does not transfer, the rights of the previous land holder are not lost. The defendant has been charged by the Public Prosecutor with the charge that because the defendant violated, in this case, the PPAT cannot be held criminally responsible for making a party deed (partijn akten) which is based on false information, and cannot fulfill the formulation of the element of the criminal act of forgery. / Peralihan hak atas tanah dapat terjadi karena peristiwa hukum dan perbuatan hukum. Pokok permasalahan dalam tesis ini adalah bagaimana perlindungan hukum bagi pemegang hak atas peralihan tanah yang dibuat oleh PPAT (Pejabat Pembuat Akta Tanah) tanpa kehadiran pemilik tanah ditinjau dari putusan nomor 53/Pid.B/2017/PN.End dan bagaimana pertimbangan hukum dan amar putusan perkara nomor 53/Pid.B/2017/PN.End. Penelitian ini adalah penelitian yuridisnormatif yang menggunakan data kepustakaan, peraturan perundang-undangan dan pendekatan kasus dalam penelitian. Hasil dari penelitian adalah bahwa peralihan tanah yang dibuat oleh PPAT tanpa kehadiran salah satu pihak, berupa tidak sahnya akta hibah tersebut sehingga pemegang hak atas tanah tersebut tetap tidak beralih, hak pemegang tanah sebelumnya tidak jadi hilang. Terdakwa telah didakwa oleh Penuntut Umum dengan dakwaan Karena terdakwa melanggar, dalam perkara ini, PPAT tidak dapat dimintai pertanggungjawaban pidana terkait dengan pembuatan akta pihak (partijn akten) yang didasarkan pada keterangan palsu, dan tidak dapat memenuhi rumusan unsur tindak pidana pemalsuan.
