Abstract

Pendaftaran tanah yang merupakan legal Cadastre, merupakan suatu rangkaian kegiatan yang dilakukan oleh Negara atau Pemerintah secara terus-menerus dan teratur, berupa pengumpulan keterangan atau data tertentu mengenai tanah-tanah tertentu yang ada di wilayah-wilayah tertentu, pengolahan, penyimpanan dan penyajiannya bagi kepentingan rakyat, dalam rangka memberikan jaminan kepastian hukum dibidang pertanahan, termasuk penerbitan tanda buktinya dan pemeliharaannya. Pendaftaran tanah merupakan suatu kegiatan administrasi yang dilakukan pemilik terhadap hak atas tanah, baik dalam pemindahan hak ataupun pemberian dan pengakuan hak, kegiatan pendaftaran tersebut memberikan suatu kejelasan status terhadap tanah. Metode penelitian yang digunakan adalah yuridis normatif yang akan disesuaikan dengan permasalahan pada penelitian ini dan didukung oleh metode penelitian yuridis empiris. Dengan jenis dan sumber bahan hukum yang dipakai adalah bahan hukum primer dan bahan hukum sekunder. Dari hasil penelitian dapat ditarik kesimpulan mengenai kepastian hukum terkait dengan jangka waktu pengajuan peralihan hak balik nama dalam sertifikat, bahwa Asas kepastian hukum dapat dikatakan merupakan anak kandung dari penalaran positivisme terhadap hukum. Positivisme hukum seperti yang sebelumnya telah dijelaskan berusaha menciptakan suatu hukum yang objektif ataupun tertulis yang dibuat oleh negara untuk menciptakan keteraturan bagi masyarakatnya. Sedangkan terkait perlindungan hukum terhadap pembeli yang telah melunasi objek jual beli tanah namun pada saat proses menuju balik nama objek tanah terkena pencatatan blokir Kantor Pertanahan Nasional (BPN) karena lalainya PPAT dapat mengajukan gugatan ke Pengadilan Negeri dan atas lalainya PPAT dapat dikenakan sanksi berdasarkan Pasal 62 BAB VIII Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pedaftaran Tanah. / Land registration, which is legal cadastre, is a series of activities carried out by the State or Government continuously and regularly, in the form of collecting certain information or data regarding certain lands in certain areas, processing, storing and presenting them for the benefit of the community. the people, in order to guarantee legal certainty in the land sector, including the issuance of evidence and its maintenance. Land registration is an administrative activity carried out by the owner of land rights, both in transferring rights or granting and recognizing rights. The research method used is normative juridical which will be adapted to the problems in this study and is supported by empirical juridical research methods. The types and sources of legal materials used are primary legal materials and secondary legal materials. From the results of the study, conclusions can be drawn related to legal certainty related to the period of submitting the transfer of title transfer rights in the certificate, that the principle of legal certainty can be said to be the biological child of positivist reasoning towards the law. Legal positivism, as previously explained, seeks to create an objective or written law made by the state to create order for its people. Meanwhile, regarding legal protection for buyers who have paid off the object of sale and purchase of land, but during the process of transferring the name of the land object, the registration of the Blocking of the National Land Office (BPN) due to negligence PPAT can file a lawsuit to the District Court and for negligence PPAT can be subject to sanctions based on Article 62 CHAPTER VIII of Government Regulation Number 24 of 1997 concerning Land Registration.
