Abstract

Dalam Proses Hukum Akta Jual Beli Tanah Dan Bangunanharus dibedakan antara akta PPAT itu sendiri dan perjanjian jual beli yang dituangkan ke dalam akta oleh para pihak. Meskipun aktanya terdegradasi kekuatan pembuktiannya tetapi perjanjian jual beli di antara para pihak adalah tetap sah sepanjang syarat-syarat perjanjian jual belinya terpenuhi. Berkaitan dengan tanggung jawab, PPAT dalam melaksanakan kewenangannya membuat akta jual beli apabila melanggar ketentuan-ketentuan yang dalam Peraturan Jabatan PPAT akan dikenakan sanksi administratif seperti yang ditentukan dalam Pasal 28 PKBPN Nomor 1 Tahun 2006, dimana PPAT sebagai pejabat umum dapat diberhentikan dengan hormat dari jabatannya ataupun diberhentikan secara tidak hormat sebagai pejabat umum. Dalam penelitian ini Penulis mengkaji Putusan Majelis Pengawas Notaris kasus Nomor: 04/B/MPPN/VIII/2016, Notaris Elsye Javanka (selanjutnya disebut NotarisEJ) yang dinilai bekerja tidak profesional karena keberpihakan terhadap salah satu pihak dalam pengurusan pembuatan akta transaksi jual beli rumah secara kredit pemilikan rumah (KPR) melalui Bank Yudha Bhakti (selanjutnya disebut pihak Bank BYB).Dampak Hukum Untuk Notaris/PPAT Yang Menimbulkan Kerugian Pada Pihak Penjual Dalam Kasus Putusan MPP Nomor 04/B/MPPN/VII/2016 yaitu bahwa tanggung jawab Notaris EJ yang juga merangkap sebagai PPAT terhadap AJB yang merugikan salah satu pihak, maka perlu melihat terlebih dahulu kriteria perbuatannya. Untuk mengetahui hal tersebut perlu melihat unsur-unsurnya apakah dilakukan secara sengaja (dengan penuh kesadaran dan keinsyafan serta direncanakan oleh Notaris/PPAT yang bersangkutan) bahwa akta yang dibuatnya sengaja untuk secara bersama-sama dengan para pihak yang bersangkutan melakukan suatu tindakan hukum yang diketahuinya sebagai tindakan yang melanggar hukum. / In the Legal Process of the Deed of Sale and Purchase of Land and Buildings, a distinction must be made between the PPAT deed itself and the sale and purchase agreement as outlined in the deed by the parties. Although the deed has degraded its evidentiary strength, the sale and purchase agreement between the parties is still valid as long as the terms of the sale and purchase agreement are fulfilled. With regard to responsibility, PPAT in carrying out its authority to make a deed of sale and purchase if it violates the provisions in the PPAT Position Regulations will be subject to administrative sanctions as stipulated in Article 28 PKBPN Number 1 of 2006, where PPAT as a public official can be respectfully dismissed from his position. or dishonorably dismissed as a public official. In this study, the author examines the Decision of the Supervisory Board of the Notary Case Number: 04/B/MPPN/VIII/2016, Notary Elsye Javanka (hereinafter referred to as Notary EJ) who is considered to be working unprofessionally because of his partiality to one of the parties in managing the making of a deed of buying and selling a house legally. The Legal Impact For Notaries/PPAT Which Causes Loss to the Seller in the Case of MPP Decision Number 04/B/MPPN/VII/2016 is that the responsibility of Notary EJ who also doubles as PPAT against AJB which harms one party, it is necessary to first look at the criteria for his actions. To find out, it is necessary to look at the elements whether it is done intentionally (with full awareness and conviction and planned by the Notary/PPAT concerned) that the deed he made is intentionally to jointly with the parties concerned take a legal action which he knows to be a legal act. unlawful act.
