Abstract

Di Indonesia masih banyak ditemukannya penyeledupan hukum dalam bentuk Warga Negara Asing dapat menjadi pemilik tanah di Indonesia salah satunya dengan melakukan perkawinan campuran dengan Warga Negara Indonesia tanpa membuatkan perjanjian perkawinan, maka seluruh harta yang diperoleh dalam perkawinan akan menjadi harta bersama. Meskipun dalam perkawinan campuran suami/isteri yang berkewarganegaraan Indonesia berhak untuk memilik tanah di Indonesia termasuk didalamnya adalah Hak Milik atas tanah dan suami/isteri yang berkewarganegaraan asing turut menjadi pemilik atas tanah hak milik jika dalam perkawinan tidak dibuatkan perjanjian kawin, apabila Warga Negara Indonesia tidak ingin kehilangan haknya untuk dalam memiliki tanah dengan status tanah hak milik maka perkawinan campuran harus disertai dengan perjanjian perkawinan untuk mencegah pencampurannya harta antara Warga Negara Indonesia dan Warga Negara Asing dalam perkawinan. Tujuan dari penelitian ini untuk mengetahui status tanah hak milik yang diperoleh dalam perkawinan campuran setelah perceraian dan perjanjian-perjanjian yang telah dibuat memenuhi syarat sahnya perjanjian dan Undang-Undang Hak Tanggungan. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan analisis kualitatif atau data sekunder. Hasil dari penelitian ini adalah Notaris/ PPAT dalam membuatkan akta otentik dapat bersikap netral tanpa berpihak dengan salah satu pihak dan Undang-Undang dapat memperbaharui pengaturan mengenai Warga Negara Asing sebagai subjek penerima Hak Tanggungan agar terciptanya kepastian hukum. / In Indonesia, there are still many law’s infiltration in the form of foreigners who can become land owners in Indonesia by conducting mixed marriages with Indonesian citizens without making a marriage agreement, resulting all assets which obtained in marriage will become joint assets. Even though in a mixed marriage, the husband/wife who is an Indonesian citizen has the right to own land in Indonesia, including the right of ownership of the land and the husband/wife who is a foreigners also becomes the owner of the land with ownership rights if the marriage is not made a marriage agreement, if the Indonesian citizen does not want to lose his/her right to own land with strata title, a mixed marriage must be accompanied by a marriage agreement to prevent the mixing of assets between Indonesian citizens and foreigners in marriage. The purpose of this study is to determine the status of the land rights obtained in mixed marriages after divorce and the agreements that have been made to meet the legal requirements of the agreement and the Mortgage Right Law. This research is a normative juridical research using qualitative analysis or secondary data. The result of this research is that the Notary/Land Deed Offical in making the authentic deed can be neutral without taking sides with either party and the law can update the regulation regarding Foreigners as subject of Mortgage Right recipients in order to create legal certainty.
