Abstract

Law Number 5 Year 1999 is created in order to prevent and reduce the number of unfair business practices in Indonesia. Business conspiracy is a form of cooperation conducted by entrepreneurs with other entrepreneurs with the intention to control the relevant market in the sole interest of the conspiring entrepreneurs, while tender is a bid to submit price quotations to acquire a certain contract work in order to procure goods or provide services. Conspiracy often occurs in the process of tender, which involved either among the business owner ( seller ) or among business owner as seller and government party ( buyer ). In practice there are 3 kinds of conspiracy, which are horizontal, vertical and mixed conspiracy. The objective of this thesis is to know what are the elements of conspiracy, what are the form of conspiracy and how to determine the elements involved according to Article 22 Law Number 5 Year 1999 Concerning The Ban on Monopolistic Practices and Unfair Business Competition. To prove if there is violation of Article 22 of The Law, KPPU has to show that all of the elements present in Article 22 have been fulfilled. / UU No. 5 Tahun 1999 adalah bentuk kepedulian pemerintah Indonesia untuk menanggulangi masalah persaingan usaha tidak sehat di Indonesia. Persekongkolan adalah bentuk kerja sama yang dilakukan oleh pelaku usaha dengan pelaku usaha lain dengan maksud untuk menguasai pasar bersangkutan bagi kepentingan pelaku usaha yang bersekongkol, sedangkan yang dimaksudkan dengan tender adalah tawaran mengajukan harga untuk memborong suatu pekerjaan, untuk mengadakan barang-barang atau untuk menyediakan jasa. Lebih lanjut persekongkolan sering ditemui dalam proses lelang dengan bentuk kerjasama antar sesama pelaku usaha dan panitia tender/ penyelenggara tender, dimana jenis-jenis tersebut terbagi menjadi tiga jenis persekongkolan tender, yakni horizontal, vertikal, dan gabungan. Penulisan Tugas Akhir ini bertujuan adalah untuk mempelajari apa saja unsur-unsur dari persekongkolan tender, jenisjenis persekongkolan tender, serta bagaimana cara penanganan perkara persekongkolan tender oleh KPPU berdasarkan Pasal 22 Undang-undang Nomor 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Di dalam penanganan suatu perkara persekongkolan tender, KPPU harus menggunakan pendekatan Rule of Reason dengan membuktikan sleuruh unsur dalam Pasal 22 UU tersebut, yakni unsur pelaku usaha, pihak lain, bersekongkol, menentukan pemenang tender, dan persaingan usaha tidak sehat. Jika terbukti maka terlapor dalam perkara akan dijatuhi sanksi hukum oleh Majelis Komisi sesuai dengan fakta persidangan.
