Abstract

Surat pernyataan waris merupakan bukti keterangan berkaitan dengan orang yang telah meninggal beserta para ahli warisnya. Ahli waris merupakan orang yang berhak atas harta yang telah ditinggalkan oleh pewarisnya. Berdasarkan Keputusan Pengadilan Negeri No. 474/Pdt.G/2012/PN.Jkt.Sel, diketahui bahwa Surat Pernyataan Waris Tergugat I (Maria Theresia) tidak mempunyai kekuatan hukum. Maka dilakukan penelitian untuk mengetahui dan menganalisis bentuk perbuatan melawan hukum yang dilakukan oleh Tergugat I dan mengapa Surat Pernyataan Waris 14 Februari 2012 dinyatakan tidak mempunyai kekuatan hukum, ditinjau dari Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional No. 3 Tahun 1997 tentang Pendaftaran Tanah. Penelitian dilakukan menggunakan studi pustaka yang berhubungan dengan Surat Pernyataan Waris. Dari hasil penelitian, disimpulkan bahwa perbuatan melawan hukum yang dilakukan oleh Tergugat I ditinjau dari Kitab Undang-Undang Hukum Perdata yaitu membuat Surat Pernyataan Waris sendiri. Perbuatan tersebut menimbulkan kerugian bagi penggugat yakni tidak dapat menjalankan isi dari wasiat yang telah ditetapkan pewaris. Surat Pernyataan Waris 14 Februari 2012 yang telah diberi nomor oleh Pengadilan Negeri Jakarta Selatan No.41/War/Ket.Waris/HKM/2012/PN.Jkt.Sel tanggal 19 Maret 2012 dinyatakan tidak mempunyai kekuatan hukum. Dimana seharusnya surat pernyataan ahli waris untuk Tergugat I berdasarkan status golongan ahli waris bagi warganegara Indonesia keturunan Tionghoa dikeluarkan oleh Notaris. / The affidavit is an evidence that related to the deceased person and his heirs. An heir is a person who is entitled to the property that has been left behind by his heir. Based on District Court Decision No. 474/Pdt.G/2012/PN.Jkt.Sel, known that the Affidavit of Defendant I (Maria Theresa) has no legal force. So, research was conducted to find out and analyze the form of unlawful acts committed by Defendant I and why the Inheritance Statement Letter of February 14th, 2012 was declared to have no legal force, reviewed from the Regulation of the Minister of State of Agrarian Affairs / Head of the National Land Agency No. 3 of 1997 on Land Registration. The research was conducted using a literature study related to the Inheritance Statement Letter. From the results of the study, it was concluded that the unlawful acts committed by Defendant I were reviewed from the Civil Law Code, namely making their own Inheritance Certificate. The act causes harm to the plaintiff that is unable to carry out the contents of the will that has been determined by the heir. Inheritance Statement Letter february 14th, 2012 which has been numbered by the District Court of South Jakarta No.41 / War / Ket.Waris / HKM / 2012 / PN. Jkt.Sel dated March 19th, 2012 was declared to have no legal force. The heir's affidavit for Defendant I based on the status of the heir class for Indonesian citizens of Chinese descent issued by a notary.
