Abstract

The EEZ Delimitation between Indonesia and Vietnam is mainly caused by the different perspective on hand. First, on the perspective of Vietnam’s baseline. Indonesia sees that Vietnam is violating the UNCLOS by using the lack of definition on Article 7 of UNCLOS and measures their baseline from the outer points of fringing islands, which is far from the mainland. Second, Vietnam is proposing for the use of Continental Shelf Drift line as the EEZ line or Single Maritime Boundary. Third, Indonesia wants the case to be settled as soon as possible with the most effective way and still in line with the UNCLOS. However, Vietnam’s governmental system do not allow much room for flexibility during the negotiation, which cause the settlement to be longer. There are two main implications of the unclear EEZ Division between Indonesia and Vietnam. First is on the legal enforcement of Indonesia law. Second is the South China Sea issue. This thesis is made for the purpose of monitoring the development of Indonesia’s position on the EEZ Delimitation with Vietnam and will give the suitable next action to be taken to conclude the issue. This thesis will also further highlight Indonesia’s position on Vietnam’s claims. Qualitative method will be used to analyze and describe the issue since the sources mostly come from journals, literature findings, and interviews. The theory used to analyze the issue is Liberalism theory, along with four other concepts, namely national interest, state sovereignty, bargaining power, as well as diplomacy and diplomatic relations. / Delemitasi EEZ antara Indonesia dan Vietnam terutama disebabkan oleh perbedaan perspektif yang dihadapi. Pertama, berdasarkan perspektif baseline Vietnam. Indonesia melihat bahwa Vietnam melanggar UNCLOS dengan menggunakan definisi yang kurang tentang Pasal 7 UNCLOS dan mengukur garis dasar mereka dari titik-titik terluar pulau-pulau pinggiran, yang jauh dari daratan. Kedua, Vietnam mengusulkan penggunaan batas landas kontinene sebagai jalur EEZ atau Single Maritime Boundary. Ketiga, Indonesia menginginkan agar kasus tersebut diselesaikan sesegera mungkin dengan cara yang paling efektif dan masih sesuai dengan UNCLOS. Namun, sistem pemerintahan Vietnam tidak memungkinkan banyak ruang untuk fleksibilitas selama negosiasi, yang menyebabkan penyelesaian menjadi lebih lama. Ada dua implikasi utama dari Divisi EEZ yang tidak jelas antara Indonesia dan Vietnam. Pertama adalah penegakan hukum hukum Indonesia. Kedua adalah masalah Laut Cina Selatan. Skripsi ini akan memuat perkembangan posisi Indonesia di isu ini dan memberikan masukan untuk langkah selajutnya terhadap kasus ini. Skripis ini akan membahasa posisi Indonesia terhadap klaim oleh Vietnam dan landasan dari posisi Indonesia. Metode kualitatif akan digunakan untuk menganalisis dan menggambarkan permasalahan ini karena sumbernya kebanyakan berasal dari jurnal, temuan literatur, dan wawancara. Teori yang digunakan untuk menganalisa isu ini adalah teori Liberalisme, bersama empat konsep lainnya, yaitu kepentingan nasional, kedaulatan negara, daya tawar, serta hubungan diplomasi dan diplomatik.
