Abstract

Informasi yang harus diketahui jelas, terang dan benar oleh pihak pembeli apartemen, mengenai bagian bersama dan benda bersama berdasarkan Undang- Undang No. 20 Tahun 2011 tentang Rumah Susun. Rumusan masalah dalam tesis ini, mengenai perjanjian yang memasukkan luasan semi gross dalam perjanjian pengikatan jual beli apartemen yang digunakan oleh developer memanfaatkan kedudukan dan menyalahgunakan keadaan (misbruik van omstandigheden) dan perjanjian pengikatan jual beli yang menggunakan semi gross area dapat merugikan konsumen. Tesis ini, menggunakan metode penelitian normatif empiris dengan data primer dan sekunder yang dianalisis secara kualitatif untuk mendapatkan kesimpulan tentang perjanjian yang memasukan luasan semi gross dalam perjanjian pengikatan jual beli apartemen yang digunakan oleh developer memanfaatkan kedudukan dan menyalahgunakan keadaan (misbruik van omstandigheden) ke dalam konsep baku perjanjian pengikatan jual beli apartemen dari pihak developer apartemen. Perjanjian pengikatan jual beli yang menggunakan semi gross area dapat merugikan konsumen terkait perbedaan aktualisasi hukum luas bangunan apartemen yang dibeli tidak sesuai pada saat pemasaran, perjanjian pengikatan jual beli (PPJB) dan akta jual beli dengan luas bangunan unit apartemen pada sertipikat hak milik satuan rumah susun. / Information that must be known clearly, clearly and correctly by the apartment buyer, regarding shared parts and shared objects based on Law no. 20 of 2011 concerning Flats. The formulation of the problem in this thesis, regarding agreements that include semi-gross area in the binding agreement for sale and purchase of apartments used by developers taking advantage of position and abusing circumstances (misbruik van omstandigheden) and binding sale and purchase agreements using semi-gross areas can harm consumers. This thesis uses empirical normative research methods with primary and secondary data analyzed qualitatively to obtain conclusions about agreements that include semi-gross areas in the apartment sale and purchase binding agreements used by developers who take advantage of position and abuse circumstances (misbruik van omstandigheden) into the concept. The standard agreement for binding the sale and purchase of apartments from the apartment developer. The sale and purchase binding agreement using semi gross area can harm consumers related to differences in the legal actualization of the apartment building area purchased that is not appropriate at the time of marketing, sale and purchase binding agreement (PPJB) and sale and purchase deed with the apartment unit building area on the certificate of ownership of the apartment unit.
