Abstract

Industrial design has been one of objects in intellectual property that is not so popular compared to other fields. In fact, it is actually important due to its ability to attract consumers in order to buy a product. Serving a product that has aesthetical element on its packaging would potentially gain more buyers, as it may convince them that the product, most likely, has better performance or quality. However, there are competitors who attempt to create similar designs on their products and still pretend that these designs are theirs. This leads us into questions concerning novelty, such as: whether or not a design has to be entirely new in appearance; and how an industrial design should be determined as the novel one. Thus , an explorative research, followed by a writing of thesis, are conducted to see how Industrial Design laws in Indonesia and other countries have defined novelty, as well as its implementation on daily basis. Based on the research , it is found that Indonesian Industrial Design law has not given clear definition and criterions on novelty and prior disclosure. This legal uncertainty creates space for examiners to conduct examinations only based on their subjectivity towards certain designs. On another note, judges who are in charge for cases on industrial designs seem to have inadequate level of understanding about regulations on intellectual property in global. These conditions lead to conclusion that there is an urgent need to educate examiners and judges on intellectual property, particularly industrial design. By this, the law would benefit not only for several people, but everyone who looks for justice through implementation of law. / Desain industri telah menjadi salah satu objek dalam kekayaan intelektual yang mungkin jarang dibahas di masyarakat, dibandingkan dengan bidang lainnya. Padahal, bidang tersebut sebenamya penting karena dapat menarik konsumen untuk membeli suatu produk. Menyajikan sebuah produk yang memiliki unsur estetika pada kemasannya akan berpotensi mendapatkan lebih banyak pembeli, karena dapat meyakinkan para pembeli bahwa produk tersebut, kemungkinan besar, memiliki kineija atau kualitas yang lebih baik. Namun, ada pesaing yang mencoba membuat desain serupa pada produk mereka dan masih berpura-pura bahwa desain ini adalah milik mereka. Hal ini membawa kita pada berbagai pertanyaan mengenai kebaruan, seperti: apakah suatu desain harus seluruhnya barn atau tidak dalam tampilannya (appearance); dan bagaimana sebuah desain industri seharusnya dikategorikan sebagai desain industri yang barn. Oleh karena itu , penelitian eksploratif, yang diikuti dengan penulisan tesis, dilakukan untuk melihat bagaimana undang-undang Desain Industri di Indonesia dan negaranegara lain telah mendefinisikan kebaruan, serta implementasinya dalam kehidupan sehari-hari. Berdasarkan penelitian tersebut, ditemukan bahwa hukum Desain Industri Indonesia belum memberikan defmisi dan kriteria yang jelas tentang kebaruan dan pengungkapan sebelumnya. Ketidakpastian hukum ini menciptakan "celah" bagi penguji untuk melakukan pemeriksaan hanya berdasarkan pada subjektivitas mereka terhadap desain tertentu. Pada sisi yang lain, hakim yang bertanggung jawab untuk kasus-kasus pada desain industri tampaknya memiliki tingkat pemahaman yang belum memadai terkait peraturan tentang kekayaan intelektual secara global. Kondisi ini mengarah pada kesimpulan bahwa ada kebutuhan yang mendesak untuk memberi edukasi bagi para penguji dan hakim mengenai kekayaan intelektual, khususnya desain industri. Dengan ini, hukum akan dapat memberi manfaat tidak hanya bagi beberapa orang, tetapi semua orang yang mencari keadilan melalui penerapan hukum.
