Abstract

Music Concert is one of the biggest sources of income for musicians and their labels. The Covid-19 causes a lot of tours and concert cancellations that have been planned by musicians all around the world. By taking advantage of technological developments, paid Virtual Concerts are becoming one of the alternatives to hold music concerts. However, with an excellent audio and visual quality, Virtual Concerts have a higher risk of copyright infringement than conventional music concerts. The purposes of this research are to examine the regulation of music copyright in Indonesia and types of copyright infringement on Virtual Concerts as well as the legal enforcement effectiveness. This research uses a Normative-Empirical method with statute approach and comparative approach supported by primary, secondary, and tertiary legal materials. The results showed that Indonesia’s Copyright Law regarding musical works is well regulated and detailed. However, in practice, sold flat agreement is still used for choreographic works when it’s not in accordance with Law Number 28 of 2014 due to the existence of a legal vacuum and it can be concluded that there’s a legal gap on Law Number 28 of 2014. The normalization of sold flat agreement for choreographic works needs to be stopped by amending Indonesia's Copyright Law and Indonesia’s Government Regulation Number 56 of 2021 regarding the additional authority for both Collective Management Organization and National Collective Management Organization. If the Choreographers earn the royalties they deserve, it will help to maintain the choreography ecosystem. Furthermore, there are various types of Copyright Infringement on Virtual Concerts that can be found such as screen recording without permission, illegal live streaming, and producing phonogram without permission.
