Abstract

One of the legal concepts in Indonesia is about business competition, where business competition is an important factor in running the economy of a country. Monopoly practice is often a concern in any discussion of competition law.In this research an analysis of the practice of monopolizing the sale of lubricants by a brand holder agent with its own brand in the automotive lubricant sector in Indonesia was linked to article 15, article 17 and article 19 of Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. The method used in this research is the conceptual approach and the statute approach. The results of the analysis of this study with the existing approach prove that the lubricant business by the ATPM violated Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. / Salah satu konsep Hukum di Indonesia adalah mengenai persaingan usaha, dimana persaingan usaha merupakan salah satu faktor penting dalam menjalankan perekonomian suatu negara. Praktek Monopoli sering menjadi perhatian dalam setiap pembahasan hukum persaingan usaha. Dalam penelitian ini diberikan analisis mengenai praktek monopoli penjualan pelumas oleh agen tunggal pemegang merek atau ATPM dengan merek sendiri pada sektor otomotif di Indonesia dikaitkan dengan pasal 15, pasal 17 dan pasal 19 UndangUndang No. 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. Metode yang digunakan dalam penelitian ini adalah pendekatan konseptual (conceptual approach) dan pendekatan perundang-undangan (statute approach). Hasil analisis penelitian ini dengan pendekatan yang ada membuktikan bahwa pelaku usaha penjualan pelumas oleh ATPM melakukan pelanggaran terhadap peraturan Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat.
