Abstract

This study aims to determine the legal protection for TKI who experience violence abroad according to the PPMI Law jo. PP No. 59 of 2021 and describes the efforts made by the Indonesian government to provide legal protection for Indonesian migrant workers who experience violence in their work relationships in Malaysia. The research method used is normative-empirical research that prioritizes secondary data in the form of relevant laws and regulations, court decisions, and expert opinions, supported by primary data. Secondary data was obtained through literature studies, scientific journals, reports, and primary data obtained through interviews with informants, namely Indonesian migrant workers in Malaysia and BP2MI. The results of the author's research illustrate that the PPMI Law jo. PP No.59 of 2021 provides preventive and repressive protection that guarantees the rights of prospective TKI and TKI by establishing and developing an information system for the placement of prospective TKI abroad, optimally fulfilling the rights and protection of TKI in the destination country, and providing protection from pre-placement, placement, and post-placement periods. Preventive protection is the administrative and technical legality of prospective TKI as well as the legality of P3MI, only the implementation has not gone well. Repressive protection for TKI who experience violence abroad is the responsibility of the Indonesian Embassy or Consulate General through assistance to victims by visiting the workplace and discussing with employers/employers, providing lawyers when proceeding in the police to court. The Government of Indonesia's efforts to provide legal protection for Indonesian labor migrants who experience violence in their working relationship abroad are to form a Memorandum of Understanding (MoU) with the Malaysian government, provide health care to Indonesian labor migrants who experience violence and return them to their homeland, seek legal proceedings, both outside the court and in the court process, legal protection for the families of migrant workers who died as a result of experiencing violence by making demands to P3MI through the courts and monitoring the implementation of P3MI's obligations towards migrant workers who experienced violence and/or who died./ Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap TKI yang mengalami kekerasan di luar negeri menurut UU PPMI jo. PP No. 59 Tahun 2021 dan menggambarkan upaya yang dilakukan oleh pemerintah Indonesia untuk memberikan perlindungan hukum terhadap TKI yang mengalami kekerasan dalam hubungan kerja di Malaysia. Metode penelitian yang digunakan adalah penelitian normatif-empiris yang mengutamakan data sekunder berupa peraturan perundang-undangan yang terkait, putusan pengadilan, dan pendapat para pakar, didukung oleh data primer. Data sekunder diperoleh melalui studi kepustakaan, jurnal ilmiah, laporan, dan data primer diperoleh melalui wawancara kepada informan, yakni TKI yang berada di Malaysia dan BP2MI. Hasil penelitian penulis menggambarkan bahwa UU PPMI jo. PP No.59 Tahun 2021 memberikan perlindungan preventif dan represif yang menjamin hak-hak calon TKI dan TKI dengan membentuk dan mengembangkan sistem informasi penempatan calon TKI di luar negeri, pemenuhan hak-hak dan perlindungan TKI secara optimal di negara tujuan, dan memberikan perlindungan dari masa pra penempatan, masa penempatan, dan purna penempatan. Perlindungan preventif yakni legalitas administrasi dan teknis calon TKI serta legalitas P3MI, hanya pelaksanaannya yang belum berjalan dengan baik. Perlindungan represif kepada TKI yang mengalami kekerasan di luar negeri adalah tanggung jawab KBRI atau KJRI melalui pendampingan kepada korban dengan mendatangi tempat kerja dan bermusyawarah dengan pengusaha/majikan, menyediakan pengacara apabila berproses di kepolisian hingga ke pengadilan. Upaya Pemerintah Indonesia dalam memberikan perlindungan hukum terhadap TKI yang mengalami kekerasan dalam hubungan kerja di Luar Negeri adalah membentuk Nota Kesepahaman (MoU) dengan pemerintah Negara Malaysia, memberikan perawatan kesehatan kepada TKI yang mengalami tindak kekerasan dan memulangkannya kembali ke tanah air, mengupayakan proses hukum, baik di luar pengadilan maupun di dalam proses pengadilan, perlindungan hukum kepada keluarga TKI yang meninggal dunia akibat mengalami kekerasan dengan melakukan tuntutan kepada P3MI melalui pengadilan serta pengawasan pelaksanaan kewajiban P3MI terhadap TKI yang mengalami kekerasan dan/atau yang meninggal dunia.
