Abstract

Perkawinan adalah suatu hubungan antara orang wanita dan pria yang bersifat abadi. Di Indonesia perkawinan telah diatur di dalam Undang - Undang Nomer 1 Tahun 1974 yang secara jelas dan rinci mengatur perkawinan. Kasus dalam penelitian ini bersangkutan dengan aset harta bersama tanpa persetujuan kawan kawin. Penelitian ini bertujuan untuk mengetahui apakah bisa harta bersama dapat dialihkan tanpa persetujuan kawan kawin. Tipe penelitian yang digunakan dalam penelitian ini adalah yuridis normatif yaitu tipe penelitian yang bersifat dogmatik dan dilakukan melalui pengumpulan bahan-bahan dan pendekatan studi pustaka. Dari hasil penelitian disimpulkan bahwa berdasarkan Pasal 36 ayat 1 Undang Undang Perkawinan bahwa harta bersama suami ataupn istri bertindak atas persetujuan kedua belah pihak. Maka dalam perundangan yang terdapat diatas secara jelas dan tegas bahwa peralihan aset harta bersama tidak dapat dilakukan tanpa persetjuan bersama. In Indonesia, marriage has been regulated in Law Number 1 of 1974 which clearly and in detail regulates marriage. The case in this study is related to joint property assets without the consent of married partners. This study aims to determine whether joint property can be transferred without the consent of married partners. The type of research used in this research is normative juridical, namely the type of research that is dogmatic in nature and is carried out through the collection of materials and a literature study approach. From the results of the study it was concluded that based on article 36 paragraph 1 of Law Number 1 of 1974 that joint assets of the husband or wife act with the approval of both parties. So in the legislation contained above, it is clear and unequivocal that the transfer of joint property assets cannot be carried out without mutual consent.
