Abstract

The purpose of this writing is to find out the legal consequences carried out by Notaries who are signing the deeds virtually in the Covid-19 pandemic situation and to find out the urgency of changes that occur regarding authentic deeds that virtually will obtain certainty, benefit and legal protection not only for notaries but also for the community.This research was conducted using normative-empirical research by examining library materials as the basis for analyzing regulations and literature related to field data obtained from interviews as supporting materials. Sources of data used in this study are primary data in the form of interviews and secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data that has been obtained by the author will be analyzed descriptively with an approach approach to get answers to the problems.The results of the research and analysis in this writing are that electronic signatures have actually been regulated in Indonesia in Law Number 19 of 2016 concerning Electronic Information and Transactions. It's just that the virtual signing of the deed using electronics does not yet have a strong legal basis in Indonesia. Legal certainty also cannot be achieved because there are still conflicting provisions in Law Number 2 of 2014 concerning Notary Positions. The Covid-19 pandemic period caused other professions to be able to use electronics but there were exceptions because there were no clear specific rules regarding this and various things that appeared when they appeared virtually, resulting in uncertainty, injustice and the absence of legal protection for employees. Adherent to the position of a notary. Therefore, it is necessary to make changes to laws and regulations or legal products so that there is a synchronization and harmonization of laws. The government needs to increase the role of the notary in accordance with the times and regulate the legal strength and authenticity of data as well as the strength of the electronic deed which has been an obstacle to proof./ Penelitian ini bertujuan untuk mengetahui akibat hukum serta kendala yang timbul dalam penandatanganan akta oleh notaris yang dilakukan secara virtual dalam situasi pandemi Covid-19 serta mengetahui urgensi perubahan ketentuan mengenai penandatanganan akta otentik secara virtual agar dapat memperoleh kepastian, keadilan, kemanfaatan dan perlindungan hukum bukan hanya bagi para notaris namun juga kepada masyarakat.Penelitian ini dilakukan dengan menggunakan jenis penelitian normatif-empiris dengan meneliti bahan pustaka sebagai bahan dasar dalam melakukan analisa pada peraturan dan literatur terkait sementara data lapangan diperoleh dari wawancara sebagai bahan pendukung. Sumber data yang digunakan dalam penelitian ini adalah data primer berupa wawancara dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data yang telah penulis dapatkan akan dianalisis secara deskriptif analisis dengan pendekatan kualitatif untuk mendapatkan jawaban pada permasalahan.Hasil penelitian dan analisis dalam penulisan ini adalah tanda tangan elektronik sejatinya telah diatur di Indonesia dalam Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik. Hanya saja penandatanganan akta secara virtual dengan memanfaatkan elektronik belum memperoleh landasan hukum yang kuat di Indonesia. Kepastian hukum juga tidak dapat tercapai karena masih terdapat ketentuan yang bertentangan pada Undang�Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris. Masa pandemi Covid-19 menyebabkan profesi lain dapat melakukan tugasnya dengan memanfaatkan elektronik namun notaris dikecualikan sebab tidak adanya aturan khusus yang jelas mengenai hal ini serta adanya berbagai akibat hukum yang muncul pada penandatanganan akta oleh notaris secara virtual sehingga muncul adanya ketidakpastian, ketidakadilan dan tidak adanya perlindungan hukum bagi para penganut jabatan notaris. Oleh karena itu, diperlukan adanya perubahan pada peraturan perundang-undangan atau produk hukum agar tercapai sinkronisasi dan harmonisasi hukum. Pemerintah perlu meningkatkan peran notaris sesuai perkembangan zaman dan mengatur mengenai kekuatan hukum dan keotentikan data serta kekuatan akta elektronik yang selama ini menjadi kendala dalam pembuktian.
