Abstract

Pencemaran nama baik merupakan salah satu perbuatan pidana yang mengundang perdebatan di tengah masyarakat adalah pencemaran nama baik.Tindak pidana pencemaran nama baik berkaitan erat dengan tindakan menyerang kehormatan atau nama baik seseorang yang sifatnya subjektif dan sulit diukur. Salah satu contoh kasus terkait pencemaran nama baik dalam Putusan Nomor 828/Pid.Sus/2020/PN.Dps. Kasus ini diajukan ke Pengadilan Negeri Denpasar, dimana Jerinx terbukti secara sah dan meyakinkan bersalah dan melakukan tindak pidana pencemaran nama baik. Dan jerinx dituntut dengan Pasal 28 ayat (3) Jo. Pasal 45A Undang-undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik Jo. Pasal 64 ayat (1) Kitab Undang-undang Hukum Pidana serta pidana penjara selama 1 (satu) tahun dan pidana denda Rp.10.000.000 – (sepuluh juta rupiah/Libel is one of the most insidious crimes that have raised controversy among people, namely libel. A criminal defamation is closely associated with the attack of honor or the good name of a person who is subjective and difficult to measure. One example of case of defamation in ruling number 828/Pid.Sus/2020/PN.Dps. The case was brought to the Denpasar district court, whrere Jerinx was legally and convincingly, guilty and committed criminal defamation. And jerinx is charged with article 28 of verse (3) Jo. Article 45A of the 2008 article 11 on information and electronic transactions of Jo. Article 64 verse (1) of the Criminal Code and imprisonment for 1 (one) year and a fine of Rp.10.000.000 – (ten million rupiah).
