Abstract

Tujuan dari mengetahui praktik dagang dan sanski hukum terhadap perdagangan barang tiruan dalam menggunakan merek terkenal dan untuk mengetahui bagaimana keefektifitasan UU No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis dan mengetahui sanksi apa yang dapat diberikan Adapun permasalahan penelitian dari skripsi ini, pertama : praktik dagang terhadap perdagangan barang tiruan dalam menggunakan merek terkenal. Bagaimana sanksi hukum yang dapat diberikan berdasarkan UU terhadap perdangan barang tiruan dalam menggunakan merek terkenal. keefektivitasan UU No 20 Tahun 2016 Tentang Merek dan Indikasi Geografis dalam perdagangan barang tiruan dalam menggunakan merek terkenal Metode penelitian yang digunakan dalam penelitian ini antara lain melalui metode penelitian empiris dan juga melihat dari buku-buku, peraturan perundang-undangan, literatur-literatur, dan sumber lainya berkaitan dengan permasalahan yang diteliti. Metode pengumpulan data lainya yang digunakan adalah mencari dan mempelajari data melalui wawancara berupa tanya jawab yang dilakukan secara lansung dengan para pedagang Pasar Raya HP Dinda Ponsel, menyebarkan atau membagikan daftar pertanyaan yang telah di buat sebelumnya oleh penulis kepada masyarakat di Kota Medan. Hasil yang diperoleh dari penelitian ini anatara lain bahwa UndangUndang No.20 Tahun 2016 Tentang Merek dan Indikai Geografis belum efektif. Pada kenyataanya di lapangan masih banyak terjadi pelanggaran terhadap merek. Factor-faktor yang menyebbakan tidak efektifnya UU No 20 Tahun 2016 UUMI adalah factor hokum dan undangundang, penegak hokum , sarana dan prasarana, budaya serta kesadaran masyarakat akan hokum. Kurangnya pengetahuan dan wawasan dari pihak pedagang, dan lemahnyya pengawasan dari Intansi terkait menjadi ekndala dalam prosespelaksanaan perlindungan hokum terkait perdagangan barang palsu. Dari hasil penelitian ini diharapkan kedpan ada proses untuk mengoptimalkan upayaupaya perlindungan hokum dengan cara meningkatkan kesadaran hokum terhadap merek kepada pedagang dan konsumen untuk memperdagangkan dan membeli barang-barang palsu. / The purpose of knowing trade practices and legal sanctions against trade in counterfeit goods in using well-known brands and to find out how effective Law no. 20 of 2016 concerning Trademarks and Geographical Indications and knowing what sanctions can be given The research problems of this thesis, first: trade practices against trade in counterfeit goods using well-known brands. What are the legal sanctions that can be given under the law against the trade in counterfeit goods using well-known marks. the effectiveness of Law No. 20 of 2016 concerning Trademarks and Geographical Indications in the trade of counterfeit goods using well-known marks The research methods used in this study include empirical research methods and also look at books, legislation, literature, and other sources related to the problems studied. Another data collection method used is to find and study data through interviews in the form of questions and answers conducted directly with the traders of Pasar Raya HP Dinda Ponsel, distributing or distributing a list of questions that have been previously made by the author to the community in the city of Medan. The results obtained from this research include that Law No. 20 of 2016 concerning Marks and Geographical Indices has not been effective. In fact in the field there are still many violations of the brand. The factors that cause the ineffectiveness of Law No. 20 of 2016 UUMI are legal factors and laws, law enforcement, facilities and infrastructure, culture and public awareness of the law. The lack of knowledge and insight from the traders, and the weak supervision of the relevant agencies are obstacles in the process of implementing legal protection related to the trade in counterfeit goods. From the results of this study, it is hoped that there will be a process to optimize legal protection efforts by increasing legal awareness of brands to traders and consumers to trade and buy counterfeit goods.
