Abstract

The research aims to determine the impact of buying and selling illegal COVID-19 vaccines. The second goals is to find out about the role of the ministry of health in the case of buying and selling illegal COVID-19 vaccines in the midst of the COVID-19 pandemic that is currently being experienced in Indonesia, which has not yet been completed. This study uses a normative research method by analyzing information related to the problems discussed by the author. In this study, what was initially investigated was secondary legal data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection technique was carried out by library research by seeking information related to the problems discussed through laws and regulations, books, official documents, publications, and the internet. The data obtained from the search results were then analyzed descriptively using qualitative analysis to obtain answers to the problems that occurred. The results of the study show that the impact of buying and selling illegal COVID-19 vaccines is the loss of trust given by the public to the government and the failure of coordination and supervision in the distribution of the COVID-19 vaccine. This happened because of the lack of supervision from the local government in the implementation of the COVID-19 vaccination program. The Ministry of Health gives authority to local governments in supervising every process of carrying out vaccinations. The role of the ministry of health in responding to the illegal sale and purchase of COVID-19 vaccines is to appeal to the public to be morecareful, wise in implementing the COVID-19 vaccination program. The legal implementation of the COVID-19 vaccination is a vaccine program organized by the government and is free of charge, while the implementation of the illegal COVID-19 vaccination is the process of implementing the COVID-19 vaccination carried out by irresponsible individuals and is charged a fee in the implementation process. The Ministry of Health asked local governments to increase supervision and distribution of the COVID-19 vaccine so that the trust given by the public to the government was not in vain./ Penelitian ini bertujuan yang pertama untuk mengetahui dampak jual beli vaksin COVID-19 Illegal. Tujuan kedua yaitu mengetahui peran kementerian kesehatan dalam kasus jual beli vaksin COVID-19 Illegal ditengah pandemi COVID-19 yang sedang dialami di negara Indonesia yang sampai saat ini juga belum selesai. Penelitian ini memggunakan metode penelitian hukum normatif dengan menganalisa informasi yang berkaitan dengan permasalahan yang dibahas oleh penulis. Dalam penelitian ini, yang diteliti merupakan data hukum sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data dilakukan dengan penelitian kepustakaan dengan mencari informasi terkait permasalahan yang dibahas melalui peraturan perundang-undangan, buku-buku, dokumen resmi, publikasi, serta internet. Data yang diperoleh dari hasil pencarian kemudian dianalisa secara deskriptif dengan menggunakan analisa kualitatif untuk memperoleh jawaban atas permasalahan yang terjadi. Hasil penelitian diperoleh bahwa, dampak jual beli vaksin COVID-19 Illegal yaitu hilangnya kepercayaan yang diberikan oleh masyarakat kepada pemerintah dan kegagalan koordinasi dan pengawasan dalam distribusi vaksin COVID-19. Kurangnya pengawasan dari pemerintah daerah dalam program pelaksanaan vaksinasi COVID-19. Kementerian kesehatan memberikan wewenang kepada pemerintah daerah dalam mengawasi setiap proses pelaksanaan vaksinasi yang dilakukan. Peran kementerian kesehatan dalam menanggapi kasus jual beli vaksin COVID-19 Illegal ini adalah menghimbau kepada masyarakat untuk lebih hati-hati dan bijaksana dalam melaksanakan program vaksinasi COVID-19. Pelaksanaan vaksinasi COVID-19 yang legal merupakan program vaksin yang diselenggarakan oleh pemerintah dan tidak dipungut biaya apapun, sedangkan pelaksanaan vaksinasi COVID-19 Illegal merupakan proses pelaksanaan vaksinasi COVID-19 yang dilakukan oleh tersangka untuk mengambil keuntungan. Kementerian kesehatan meminta agar pemerintah daerah dapat meningkatkan pengawasan dan pendistribusian vaksin COVID-19 agar kepercayaan yang diberikan masyarakat kepada pemerintah tidak sia-sia.
