Abstract

Penelitian ini membahas kasus praktik monopoli dan persaingan usaha tidak sehat yang dilakukan para pelaku usaha. Penelitian ini menggunakan tipe penelitian Yuridis Normatif menggunakan pengolahan bahan hukum yang dilakukan secara studi pustaka. Penelitian ini bertujuan untuk menelaah untuk mengetahui lebih dalam lagi mengenai praktik monopoli dan persaingan usaha tidak sehat dimana terdapat pihak-pihak yang terkait dan bagaimana pertanggungjawaban yang dilakukan oleh para pelaku usaha yang telah melakukan praktik monopoli dan persaingan usaha tidak sehat. terdapat Undang-Undang yang mengatur yaitu Undang-Undang No.5 Tahun 1999 tentang larangan praktek monopoli dan persaingan usaha tidak sehat. PT.KAI melakukan kerjasama dengan LinkAja dalam penyediaan jasa pembayaran tiket kereta api jarak dekat, dalam kerjasama tersebut menimbulkan adanya praktik monopoli dan persaingan usaha tidak sehat dan PT.KAI memiliki posisi dominan karena satu-satunya penyedia jasa transportasi kereta api di Indonesia, kasus PT.KAI ini melanggar Pasal 17 Ayat 1 dan 2, Pasal 19 huruf d dan Pasal 2 Ayat 1 dan 2 Undang-Undang No.5 Tahun 1999. / This study discusses cases of monopolistic practices and unfair business competition by business actors. This research uses a normative juridical research type using legal material processing which is carried out by means of a literature study. This study aims to examine to find out more about monopolistic practices and unfair business competition where there are related parties and how the accountability is carried out by business actors who have practiced monopolistic practices and unfair business competition. There is a law that regulates, namely Law No. of 1999 concerning the prohibition of monopolistic practices and unfair business competition. PT. KAI cooperates with LinkAja in providing payment services for short distance train tickets, in this collaboration it creates monopolistic practices and unfair business competition, and PT. KAI has a dominant position because it is the only provider of rail transportation services in Indonesia, the case of PT. KAI violates Article 17 paragraphs 1 and 2, Article 19 letter d and Article 2 paragraphs 1 and 2 of Law No.5 of 1999.
