Abstract

The purpose of this thesis is to know the conditions for workers to be laid off. The second purpose is to know the legal protection of workers against unilateral termination of employment during the Covid-19 pandemic at PT Mitra Aluminum Jaya Utama. The type of research carried out is normative legal research with the aim of examining the law from several aspects such as theory, philosophy, comparison, structure/composition, consistency, general explanation and explanation of each article, formality and binding power of a law so that it can be concluded that legal research normative has a broad scope and is objected to the doctrine, principles, and principles of law. The type of data used is primary data and secondary data with library research data collection techniques and field research by conducting interviews. The results of the study show that the conditions for PT Mitra Aluminum Jaya Utama to be able to lay off workers during the Covid-19 pandemic are based on the Job Creation Act in terms of the reasons, there are efficiency and force majeure that is in accordance with Article 154A paragraph (1) letter b and letter d of the Manpower Act after According to the Job Creation Law, companies are not permanently closed but have decreased turnover and are still employing workers on a shift, laid-off and WFH system. In terms of layoff procedures, initially, layoffs were carried out unilaterally and without payment of workers' rights so that it was contrary to the provisions of Article 151 paragraph (2) and paragraph (3) of the Manpower Law No.13 of 2003 after the Job Creation Law jo. Article 15 and Article 17 of PP No. 35 of 2021 regarding Specific Time Work Agreements, Outsoucring, Working Time and Rest Time, and Termination of Employment, after workers have take actions, then it is carried out according to the applicable provisions, namely deliberation. Legal protection for workers against unilateral layoffs during the Covid-19 pandemic at PT Mitra Aluminum Jaya Utama before the layoffs is a preventive measure that has not been carried out optimally according to Kepmenakertrans No. 104 of 2021. Legal protection for workers after layoffs, the company has provided compensation money whose value is better than that stipulated in Articles 15 and 17 of PP. 35 Year 2021./ Tujuan penelitian ini adalah mengetahui syarat-syarat pekerja untuk dapat di PHK menurut UU Cipta Kerja. Tujuan kedua untuk mengetahui perlindungan hukum terhadap pekerja akibat PHK sepihak pada masa pandemi Covid-19 di PT Mitra Aluminium Jaya Utama. Jenis penelitian yang dilakukan adalah penelitian hukum normatif-empiris dengan tujuan mengkaji hukum dari segi implementasi ketentuan hukum normatif atau undang-undang dalam aksinya pada suatu peristiwa hukum tertentu yang terjadi dalam masyarakat. Pendekatan penelitian adalah non-judicial case study yaitu studi kasus hukum yang tidak ditangani oleh pengadilan. Jenis data yang digunakan adalah data sekunder didukung oleh data primer. Teknik pengumpulan data sekunder adalah library research dan pengumpulan data primer dilakukan dengan penelitian lapangan di PT Mitra Aluminium Jaya Utama melalui melakukan wawancara. Analisis data dilakukan secara kualitatif. Hasil penelitian menunjukan syarat PT Mitra Aluminium Jaya Utama untuk dapat melakukan PHK terhadap pekerja pada masa pandemi Covid-19 berdasarkan UU Cipta Kerja ditinjau dari alasannya adalah efesiensi dan force majeure telah sesuai dengan Pasal 154A ayat (1) huruf b dan huruf d UU Ketenagakerjaan setelah UU Cipta Kerja, perusahaan tidak tutup permanen tetapi mengalami penurunan omzet dan masih memperkerjakan pekerja dengan sistem shift, dirumahkan dan WFH. Dari segi prosedur PHK awalnya dilakukan PHK sepihak dan tanpa pembayaran hak-hak pekerja sehingga bertentangan dengan ketentuan Pasal 151 ayat (2) dan ayat (3) UU Ketenagakerjaan No.13 Tahun 2003 setelah UU Cipta Kerja jo. Pasal 15 dan Pasal 17 PP No. 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja, setelah pekerja melakukan aksi barulah dilakukan sesuai ketentuan yang berlaku yaitu musyawarah. Perlindungan hukum bagi pekerja terhadap PHK sepihak pada masa pandemi Covid-19 di PT Mitra Aluminium Jaya Utama sebelum PHK yaitu upaya pencegahan yang belum dilakukan secara maksimal sesuai Kepmenakertrans No. 104 Tahun 2021. Perlindungan hukum pekerja setelah PHK, perusahaan sudah memberikan uang kompensasi yang nilainya lebih baik dibandingkan yang diatur pada Pasal 15 dan 17 PP No. 35 Tahun 2021.
