Abstract

This study has three objectives: To find out the chronology of Japanese anime plagiarism cases against Korean games. To find out observations related to the Korean Anime Game plagiarism case which ended without a court or court decision. To find out the implementation of the Indonesian Copyright Law and the Japanese Copyright Law related to the Japanese Anime plagiarism case against Korean Games. Comparison of the laws of the Copyright Law and the Japanese Rights Act which is the focus of research to achieve research. This research method uses normative juridical law research. Normative juridical law research prioritizes secondary data which includes primary legal materials, secondary legal materials and tertiary legal materials. Secondary data is then created with primary data based on the Copyright Law and the Japanese Copyright Law related to problems in the form of a comparison of Indonesian copyright law and Japanese copyright law. The Tertiary data obtained is then used as an answer to the resolution of the death of this plagiarism case. The results of this study are based on three problems. First, the chronology of the Japanese Anime plagiarism case against the Korean Game which provides a complete picture of this plagiarism case clearly that Tennine has committed plagiarism in terms of design to the concept of the game it released. Second, the settlement of the Japanese Anime plagiarism case which explains that the incident has been completed and the evidence is completed without a court decision, namely by an official announcement in the GM Tennine family in Korean as concrete evidence. The actions taken by Tennine have indeed resolved this, but it is considered cowardly enough that they simply closed the game that was already released and the case just disappeared without any legal action acting as if it made copyrights in Japan look different. Third, the comparison of the Indonesian Copyright Law and the Japanese Copyright Law regarding this plagiarism case where both of them have strong protection related to plagiarism acts, even the sanctions given are layered and quite heavy, but the process that must be passed is such as conflict and reporting related actions. which is quite complicated and costs money for the copyright case reporting system, which makes some parties reluctant to do it./ Penelitian ini memiliki tiga tujuan: untuk mengetahui kronologis kasus plagiarisme Anime Jepang terhadap game korea. Untuk mengetahui penyelesaian perselisihan terkait kasus plagiarisme Anime Jepang terhadap Game Korea yang sudah berakhir tanpa adanya jalur pengadilan atau putusan pengadilan. Untuk mengetahui implementasi UU Hak Cipta Indonesia dan UU Hak Cipta Jepang terkait kasus plagiarisme Anime Jepang terhadap Game Korea. Perbandingan hukum UU Hak Cipta dan UU Hak Jepang yang menjadi fokus penelitian untuk mencapai hasil penelitian. Metode penelitian ini menggunakan penelitian hukum yuridis normatif. Penelitian hukum yuridis normatif mengutamakan data sekunder yang meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Data sekunder itu kemudian dikaitkan dengan data primer berdasarkan UU Hak Cipta dan UU Hak Cipta Jepang terkait permasalahan penelitian berupa perbandingan hukum hak cipta indonesia dan hukum hak cipta jepang. Data Tersier yang diperoleh kemudian dijadikan jawaban atas penyelesaian perselisihan kasus plagiarisme ini. Hasil dari penelitian ini ada tiga berdasarkan permasalahan. Pertama, kronologis kasus plagiarisme Anime Jepang terhadap Game Korea yang memberikan gambaran lengkap tentang kasus plagiarisme ini yang secara jelas bahwa pihak Tennine melakukan tindakan plagiarisme dari segi desain hingga konsep game yang dikeluarkannya itu. Kedua, penyelesaian perselisihan kasus plagiarisme Anime Jepang terhadap Game Korea yang dimana menjelaskan bagaimana penyelesaian perselisihan yang terjadi dan bukti bahwa kasus itu telah selesai walau tanpa adanya putusan pengadilan yaitu dengan pengumuman resmi yang dikeluarga GM Tennine dalam bahasa korea sebagai bukti konkrit. Tindakan yang dilakukan Tennine memang telah menyelesaikan perselisihan ini namun dinilai cukup pengecut karena mereka hanya menutup game yang sudah rilis itu dan kasus ini hilang begitu saja tanpa adanya tindakan hukum yang bertindak seolah membuat hukum hak cipta di Jepang terlihat tidak tegas sama sekali. Ketiga, perbandingan implementasi UU Hak Cipta Indonesia dan UU Hak Cipta Jepang terkait kasus plagiarisme ini dimana sebenarnya keduanya sama-sama memiliki perlindungan yang kuat terkait tindakan plagiarisme, bahkan sanksi yang diberikan pun berlapis dan cukup berat akan tetapi proses yang harus dilalui seperti penyelesaian sengketa dan pelaporan terkait tindakan hak cipta terbilang cukup rumit dan dikenakan biaya untuk sistem penuntutan kasus hak cipta sehingga membuat sebagian pihak enggan untuk menjalaninya.
