Abstract

This research aims to find out the form of legal protection against consumers in the case of used Rapid Antigen Test at Kualanamu Deli Serdang International Airport and to find out the impact of the case of used Rapid Test Antigen at Kualanamu Deli Serdang International Airport to the public. The method used in this research is a type of empirical legal research method using qualitative data analysis techniques. This method is carried out by taking data from literature, such as books, documents, reports, journals, invitations, and so on and also taking from interview data to the Directorate of Special Criminal Investigation of the North Sumatra Regional Police and the dissemination of surveys distributed online through social media to the people of medan city. The results of the study found that legal protection of consumers in the case of the use of used Rapid Test Antigen at Kualanamu Deli Serdang International Airport has 2 (two) different points of view, where for the consumer protection community in this case is less fulfilled and felt by consumers or the public, while the point of view of the police has been fulfilled seeing the strict action enforced to the perpetrator. The impact caused by the case to the community is disappointed and upset to the Kualanamu Deli Serdang International Airport, PT. Chemical Farma Diagnostics, and those who can take advantage in pandemic situations, mistrust, fear of doing Rapid Tests. Based on this, the government should pay more attention to the organizers of COVID-19 checking services in processing waste or COVID-19 test kits that have been used so as not to be misused by irresponsible parties./ Penelitian ini memiliki tujuan untuk mengetahui bentuk perlindungan hukum terhadap konsumen dalam kasus Rapid Test Antigen bekas di Bandara Internasional Kualanamu Deli Serdang dan untuk mengetahui dampak yang ditimbulkan dari kasus Rapid Test Antigen bekas di Bandara Internasional Kualanamu Deli Serdang kepada masyarakat. Metode yang digunakan dalam penelitian ini adalah jenis metode penelitian hukum empiris dengan menggunakan Teknik analisis data kualitatif. Metode ini dilaksanakan dengan mengambil data dari kepustakaan, seperti buku, dokumen, laporan, jurnal, perUndang-Undangan, dan lain sebagainya dan juga pengambilan dari data wawancara kepada pihak Direktorat Reserse kriminal Khusus Kepolisian Daerah Sumatera Utara dan penyebaran survey yang disebarkan secara online melalui social media kepada masyarakat kota medan. Hasil penelitian didapatkan bahwa Perlindungan hukum terhadap konsumen dalam kasus penggunaan Rapid Test Antigen bekas di Bandara Internasional Kualanamu Deli Serdang memiliki 2 (dua) sudut pandang yang berbeda, dimana bagi masyarakat perlindungan konsumen dalam hal ini kurang terpenuhi dan dirasakan oleh konsumen atau masyarakat, sedangkan sudut pandang pihak kepolisian hal ini sudah terpenuhi melihat tindakkan tegas yang ditegakkan kepada pelaku. Dampak yang ditimbulkan oleh kasus tersebut kepada masyarakat adalah kecewa dan kesal kepada pihak Bandara Internasional Kualanamu Deli Serdang, PT. kimia Farma Diagnostik, dan pihak-pihak yang tega mengambil keuntungan di situasi pandemi, ketidakpercayaan, rasa takut melakukan Rapid Test. Berdasarkan hal tersebut sebaiknya pemerintah lebih memperhatikan kepada pihak penyelenggara pelayanan pengecekkan COVID-19 dalam mengolah limbah atau alat tes COVID-19 yang sudah digunakan agar tidak disalahgunakan oleh pihak yang tidak bertanggung jawab.
