Abstract

Banyaknya dampak yang ditimbulkan dari pemahaman-pemahaman asing berakibat langsung terhadap nilai-nilai budaya yang terjadi di masyarakat. Sebagai salah satu dampak yang terjadi adalah dengan adanya perilaku pergaulan bebas. Pergaulan bebas memicu terjadinya seks bebas, sedangkan peningkatan seks bebas yang tinggi di dalam perilaku masyarakat akan berdampak lurus terhadap terjadinya praktik prostitusi.Seperti pada kasus praktik prostitusi online yang dilakukan anak dibawah umur di kota Surabaya yang berumur 15 tahun berinisial C. anak tersebut melakukan tindakan praktik prostitusi online dengan penuh kesadaran dan tanpa paksaan siapapun, dan dalam aksinya praktik tersebut dibantu oleh orang dewasa yang berinisial OS.Skripsi ini menggunakan metodelogi Statue Approach dan Case Approach Hasil pembahasan dalam skripsi ini menyatakan bahwa tindakan yang dilakukan oleh Anak C tidak dapat dimintakan pertanggungjawaban pidana berdasarkan UU ITE JO. UU Perlindungan Anak, karena Anak C bukan bertindak sebagai penyedia jasa prostitusi melainkan sebagai korban prostitusi. / The many impacts that arise from foreign understandings have a direct impact on cultural values that occur in society. As one of the impacts that occur is with the behavior of promiscuity. Promiscuity triggers the occurrence of free sex, while the high increase in free sex in people's behavior will have a direct impact on the practice of prostitution. As in the case of online prostitution practices carried out by minors in the city of Surabaya, who was 15 years old with the initials C. The child carried out online prostitution practices with full awareness and without coercion from anyone, and in this practice the practice was assisted by adults with the initials OS. This thesis uses the Statue Approach and Case Approach. The results of the discussion in this thesis state that the actions taken by Child C cannot be held criminally responsible under the ITE Law JO. Child Protection Law, because Child C does not act as a prostitution service provider but as a victim of prostitution.
