Abstract

The purpose of the research that led to the creation of this thesis was to learn about, review, and analyze the different types of accountability for illegal mobile phone businesses (black market) and legal protection for mobile phone distributors who have suffered losses as a result of the illegal mobile phone circulation (black market). The research method used in this research) is library research or literature studies, which involves collecting data from books, journals, dictionaries, and laws and regulations. As social organisms, humans require communication. If there is a medium, which is a tool or means of communication between two or more persons. One of the instruments or ways of communication that can be employed is the mobile phone. The existence of mobile phones is significant, as it encourages people to purchase them. However, society’s economics status fluctuates. People with lower-middle-class incomes choose to purchase low-cost mobile phones. As a result circumtances, the black market arose to offer its goods at a lower price. People are more interested in buying it on the black market because of the low price, even if they are aware that black market goods are unlawful and against Indonesian law. Many mobile phone distributors have experienced losses as a result of unfavorable commercial rivalry. As a result, mobile phone distributors require legal protections, specifically the existence of a regulation that prohibits the selling of goods on the black market./ Tujuan Penelitian yang menjadi dasar penulisan skripsi ini untuk mengetahui, mengkaji dan menganalisis tentang bentuk pertanggungjawaban pelaku usaha ponsel ilegal (black market) dan perlindungan hukum terhadap distributor ponsel yang mengalami kerugian akibat peredaran ponsel ilegal (black market). Metode penelitian yang digunakan yaitu jenis penelitian normatif yuridis yang menggunakan library research atau studi kepustakaan dengan cara mengumpulkan data-data dari buku-buku, jurnal, kamus dan peraturan perundang-undangan yang terkait. Manusia sebagai makhluk sosial membutuhkan komunikasi. Komunikasi dapat dilakukan jika adanya suatu media yaitu alat atau sarana dalam melakukan komunikasi antara dua orang atau lebih. Ponsel adalah salah satu alat atau sarana yang dapat digunakan untuk melakukan komunikasi. Keberadaan ponsel yang penting, membuat masyarakat tertarik untuk membelinya. Namun, tingkat ekonomi dari masyarakat berbeda-beda. Masyarakat yang ekonominya menengah ke bawah memilih untuk membeli ponsel yang murah. Melihat keadaan yang demikian, pasar gelap (black market) pun mulai bermunculan dan menjual barangnya dengan harga yang lebih murah. Harga murah tersebut membuat masyarakat menjadi lebih tertarik untuk membelinya di pasar gelap (black market), meskipun mereka mengetahui barang black market merupakan barang ilegal yang bertentangan dengan hukum di Indonesia. Keberadaan pasar gelap (black market) ini mengkhawatirkan distributor yang ada di Indonesia. Distributor ponsel banyak yang mengalami kerugian dan terjadi persaingan usaha yang tidak sehat. Maka, distributor ponsel membutuhkan perlindungan hukum yaitu adanya suatu peraturan yang dibentuk agar penjualan barang di pasar gelap (black market) dapat dihentikan.
