Abstract

Indonesia as a democracy has a general election to determine the governor of a region. To ensure that a balanced democratic competition is achieved, there are several regulations that cause a vacancy in the position of Governor in a given province. In the event of a vacancy, the State Civil Apparatus (ASN) can replace the Governor by serving as the Governor's Temporary Officer (Plt Governor). However, there are several situations where these positions are filled by members of the Indonesian Armed Forces (TNI) or the Indonesian National Police (Polri), where this creates an ambiguity in the duties and authorities of the TNI/Polri institutions which should be neutral and not occupy political positions in a country. The Researcher conducted this research based on the Theory of Dignified Justice. This type of research is a juridical-empirical research with a statutory approach. The results of this study The researcher concludes that the appointment of the TNI/Polri as Acting Governor is a policy that is not in accordance with the Theory of Dignified Justice.
