Abstract

The rapid development of the business world makes the role of brands very important in maintaining business competition. Today, infringement of well-known brands is very common in Indonesia. This study discusses one of the well-known brand violations that occurred in Indonesia, namely the dispute between HUGO BOSS Trade Mark Management GmbH & Co.KG and Teddy Tan in accordance with the decision No.01/Pdt.Sus-Merek/2019/PN.Niaga Jkt. Pst, this study aims to find out legal protection and legal settlement are if there is a trademark registration that has similarities in principle with a registered and/or well-known mark. The research method used in this research is normative legal research. The author will understand and analyze the decision No.01/Pdt.Sus-Merek/2019/PN. Commerce Jkt. Pst and use secondary data to further expand the discussion in this study. The data analysis in this study is qualitative. The results of the research that the author got were the cancellation of Teddy Tan's brands, namely HUGO FEMININE, HUGO BOY and HUGO JEANS which were registered on the basis of bad faith and were proven to have similarities in principle with the brand owned by HUGO BOSS Trade Mark Management GmbH & Co.KG, namely HUGO BOSS( and variations thereof) so that the mark must be canceled by law. The HUGO BOS brand belonging to HUGO BOSS Trade Mark Management GmbH & Co.KG is also recognized as a well-known brand, which should be guaranteed protection. This shows that the implementation of repressive protection is quite good. However, the implementation of preventive protection is still less than optimal because the Director General of Intellectual Property Rights is less thorough in accepting applications for trademark registration, considering that in Article 21 of the MIG Law it is stated that applications for trademark registration will be rejected if they have similarities in principle with registered and/or well-known marks. Therefore, the Director General of Intellectual Property Rights needs to increase accuracy in accepting applications for trademark registration and the need for socialization to the public about the importance of understanding Intellectual Property Rights, especially Mark Rights./ Pesatnya perkembangan dunia usaha membuat peran merek menjadi sangat penting dalam menjaga persaingan usaha. Dewasa ini, pelanggaran terhadap merek terkenal sangat sering terjadi di Indonesia. Penelitian ini membahas salah satu pelanggaran merek terkenal yang terjadi di Indonesia yaitu sengketa antara HUGO BOSS Trade Mark Management GmbH & Co.KG dengan Teddy Tan sesuai dengan putusan No.01/Pdt.Sus-Merek/2019/PN.Niaga.Jkt.Pst, penelitian ini bertujuan untuk mengetahui perlindungan hukum dan penyelesaian hukum apabila terdapat pendaftaran merek yang memiliki persamaan pada pokoknya dengan merek terdaftar dan/atau terkenal. Metode penelitian yang digunakan dalam penelitian ini ialah penelitian hukum normatif. Penulis akan memahami dan menganalisi putusan No. 01/Pdt.Sus-Merek/2019/PN.Niaga.Jkt.Pst dan menggunakan data sekunder untuk lebih memperluas pembahasan dalam penelitian ini. Analisis data dalam penelitian ini bersifat kualitatif. Hasil penelitian yang penulis dapatkan ialah dibatalkannya merek milik Teddy Tan yaitu HUGO FEMININE, HUGO BOY dan HUGO JEANS yang didaftarkan atas dasar itikad tidak baik dan terbukti mempunyai persamaan pada pokoknya dengan merek milik HUGO BOSS Trade Mark Management GmbH & Co.KG yaitu HUGO BOSS(beserta variasinya) sehingga merek tersebut harus dibatalkan demi hukum. Merek HUGO BOS milik HUGO BOSS Trade Mark Management GmbH & Co.KG juga dinyatakan sebagai merek terkenal, dimana seharusnya mendapatkan jaminan perlindungan. Hal tersebut menunjukkan pelaksanaan dari perlindungan represih sudah cukup baik. Namun, pelaksanaan dari perlindungan preventif masih kurang maksimal dikarenakan Dirjen HaKI yang kurang teliti dalam menerima permohonan pendaftaran merek, mengingat dalam padal 21 UU MIG dikatakan bahwa permohonan pendaftaran merek akan ditolak apabila memiliki persamaan pada pokoknya dengan merek terdaftar dan/atau terkenal. Maka dari itu, Dirjen HaKI perlu meningkatkan ketelitian dalam menerima permohonan pendaftaran merek dan perlunya sosialisasi kepada masyarakat tentang pentingnya pemahaman akan Hak Kekayaan Intelektual khususnya Hak Merek.
