Abstract

The purpose of the research was to determine the criminal liability of business actors for the procurement of government goods and services proven to be entangled in corruption and to determine the role of business actors in the procurement of government goods and services at the Steam Power Plant in preventing corruption. The research method used in this study is normative juridical, this study used library activities with a legal and conceptual approach. This study aims to analyze the accountability of private business actors for corruption in the procurement of government goods and services, especially in the steam power plant section in the Riau area. The results of the research are in the form of criminal liability for business actors in the procurement of government goods and services who are proven to have committed criminal acts of corruption, namely loading a black list for a maximum of two calendar years, not being able to participate in the procurement process for goods/services in a civil lawsuit, and criminal sanctions as stated in the positive laws and regulations in Indonesia, and the participation of business actors in the procurement of government goods and services in preventing corruption, it is necessary to apply the principles of procurement of goods and services, namely Efficient, Effective, Transparent, open, competitive, fair and accountable, and ethical procurement of goods and services, namely carrying out duties in an orderly manner, accompanied by a sense of responsibility, working professionally, bathing and maintaining the confidentiality of information, not influencing each other, being responsible, avoiding waste, preventing abuse of authority, and not accepting, offering or promising or accepting gifts or reward./ Tujuan Penelitian adalah untuk mengetahui pertanggungjawaban pidana pelaku usaha atas pengadaan barang dan jasa pemerintahan yang terbukti terjerat tindak pidana korupsi dan untuk mengetahui peran serta pelaku usaha pengadaan barang dan jasa pemerintahan Pembangkit Listrik Tenaga Uap dalam mencegah tindak pidana korupsi. Metode Penelitian yang digunakan dalam penelitian ini yaitu menggunakan yuridis normatif, dalam penelitian ini digunakan kegiatan kepustakaan dengan pendekatan secara Undang-Undang dan konseptual. Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pelaku usaha swasta atas tindak pidana korupsi pengadaan barang dan jasa pemerintah terutama di bagian pembangkit listrik tenaga uap di daerah Riau. Hasil Penelitian berupa pertanggungjawaban pidana bagi pelaku usaha pengadaan barang dan jasa pemerintahan yang terbukti melakukan tindak pidana korupsi, yaitu pemuatan daftar hitam maksimal dua tahun kalender, tidak dapat ikut serta dalam proses pengadaan barang/jasa gugatan secara perdata, dan sanksi pidana sebagaimana tercantum di dalam peraturan perundang-undangan yang berlaku positif di Indonesia, dan peran serta pelaku usaha pengadaan barang dan jasa pemerintahan dalam pencegahan tindak pidana korupsi, diperlukannya penerapan prinsip pengadaan barang dan jasa yaitu efisien, efektif, Transparan, terbuka, bersaing, adil dan akuntabel, serta etika pengadaan barang dan jasa yaitu melaksanakant tugas secara tertib, disertai rasa tanggung jawab, bekerja secara profesional, mandi dan menjaga kerahasiaan informasi, tidak saling mempengaruhi, bertanggung jawab, menghindari pemborosan, mencegah penyalahgunaan wewenang, dan tidak menerima, menawarn atau menjanjikan atau menerima hadiah atau imbalan.
