Abstract

Mengingat arti pentingnya tanah bagi kelangsungan hidup masyarakat, maka diperlukan peraturan yang lengkap dalam hal penggunaan, pemanfaatan, pemilikan dan perbuatan hukum yang berkaitan dengan hal tersebut. Tanah merupakan kebutuhan hidup manusia yang sangat mendasar. Dapat dikatakan hampir semua kegiatan hidup manusia baik secara langsung maupun tidak langsung selalu memerlukan tanah. Tanah dibutuhkan oleh banyak orang sedangkan tanah jumlahnya tidak bertambah atau tetap, sehingga tanah yang tersedia tidak mampu lagi memenuhi kebutuhan yang terus meningkat. Seringkali terjadi tumpang tindih kepemilikkan karena kurangnya informasi dan pengetahuan yang didapatkan, maka seperti yang akan dibahas dalam tulisan ini yaitu mengenai sengketa kepemilikkan hak atas tanah yang terjadi pada perkara dalam Putusan Pengadilan Negeri Nomor: 4/Pdt.G/2019/PN Wtp. Tergugat melakukan Perbuatan Melawan Hukum dengan menggadaikan tanah tersebut tanpa seizin dan sepengetahuan pemilik tanah tersebut yaitu Penggugat. Penelitian ini bersifat yuridis normatif yang mana dalam prosesnya penulis menggunakan studi kepustakaan melalui putusan pengadilan serta sumber – sumber bacaan terkait. / Given the importance of land for the survival of the community, it is necessary to complete regulations regarding the use, utilization, ownership and legal actions related to this matter. Land is a very basic human need. It can be said that almost all activities of human life, either directly or indirectly, always require land. Land is needed by many people while the amount of land does not increase or remain, so the available land is no longer able to meet the increasing needs. There is often overlapping ownership due to lack of information and knowledge obtained, so as will be discussed in this paper, namely regarding the dispute over land rights that occurred in the case in the District Court Decision Number: 4/Pdt.G/2019/PN Wtp. So that the Defendant committed an unlawful act by mortgaging the land without the permission and knowledge of the owner of the land, namely the Plaintiff.
