Abstract

Notary code of ethics applies for all Notaries in Indonesia and must be obeyed by all Notaries. The use of notary sign is one of the obligatory which must be performed by Notary, where all the standard requirements has been described in article three (3) from Code of Ethics. Violation of inappropriate use of notary sign has also been described in article six (6) from Code of Ethics. The purpose of this study is to find out about the application of the use of notary sign in accordance with Code of Ethics and penalties given for violations committed in relation of notary sign usage. It can be concluded by using juridical normative method that the use of notary sign are regulated in article 3 of Notary Code of Ethics. Although there are already standard regulations regarding this notary sign, still there are inappropriate signages. If there is no changes in these violations, Honorary Council can discharge notary sign that are not in accordance with Notary Code of Ethics. / Kode Etik Notaris berlaku untuk semua Notaris di Indonesia serta wajib ditaati oleh seluruh Notaris. Penggunaan papan nama notaris merupakan salah satu kewajiban yang harus dilakukan oleh Notaris, dimana syarat-syarat untuk standar papan nama tersebut sudah dijelaskan dalam Pasal 3 Kode Etik. Pelanggaran terhadap penggunaan papan nama yang tidak sesuai standar tersebut juga dijelaskan dalam Pasal 6 Kode Etik. Tujuan penelitian ini untuk mengetahui tentang penerapan dari penggunaan papan nama notaris yang sesuai dengan Kode Etik dan sanksi yang diberikan terhadap pelanggaran yang dilakukan sehubungan dengan penggunaan papan nama tersebut. Dapat diambil kesimpulan dengan menggunakan metode yuridis normatif bahwa pemasangan papan nama notaris terdapat standar yang diatur di dalam Pasal 3 Kode Etik Notaris. Meskipun sudah ada ketentuan mengenai standar pemasangan papan nama notaris, tetapi masih ada penggunaan yang tidak sesuai. Jika tidak ada perubahan dari pelanggaran papan nama tersebut, Dewan Kehormatan bisa melakukan penurunan papan nama notaris yang tidak sesuai dengan standar Kode Etik Notaris.
