Abstract

Pendidikan yang terstruktur, merata dan berkesinambungan merupakan kemutlakan yang tidak terbantahkan jika kita menginginkan perubahan radikal bagi manusia Indonesia. Karena itu, Konstitusi menjamin bahwa setiap warga negara berhak menadapatkan pendidikan, serta mengamanatkan agar pemerintah mengusahakan dan menyelenggarakan suatu sistem pendidikan nasional dengan komitmen ‘long life education’. Sehinga setiap regulasi pendidikan yang dibuat oleh Pemerintah haruslah memudahkan kegiatan berusaha dibidang pendidikan, khususnya investasi pendidikan dasar dan menengah yang dikelola oleh swasta. Jangan sampai peraturan-peraturan pelaksana pendidikan yang drajatnya jauh di bawah kontitusi malah menghambat terciptanya investasi dan menutup peran serta keterlibatan masyarakat dalam memajukan pendidikan nasional. Kenyataan yang terjadi saat ini membuktikan bahwa pihak swasta yang memiliki kerinduan untuk melayani pendidikan nasional belum mendapatkan kemudahan untuk berinvestasi bahkan terkesan dihambat dengan regulasi setingkat Peraturan Menteri. / A structured, even, and continuous form of education is an inevitable certainty if we wish to see a radical change for the Indonesian people. Therefore, the Constitution guarantees that each citizen has the right to education, as well as ordering that the government ensures and runs an educational system with a 'long life education' commitment. As a result each regulation concerning education made by the Government must ease commercial activities in the sector of education, especially investing in primary and secondary education managed by the private sector. The technical regulations that are lower in hierarchy compared to the Constitution may not hamper the presence of investment and limit the involvement of the people in improving national education. Reality shows that several parties in the private sector that are eager to contribute to national education have not been granted the ease of passage to invest, rather feeling that they are held back by regulations equivalent to the Ministry Regulations.
