Abstract

Berdasarkan Badan Statistik Pusat (BPS) banyak masyarakat yang kehilangan pekerjaan efek Covid-19. Sehingga masyarakat melihat pinjaman online sebagai jalan alternatif untuk pemenuhan pendapatan dan kebutuhan sehari-hari. Dengan melihat banyaknya antusias masyarakat terhadap pinjaman online yang dimana pinjaman online merupakan bentuk dari inovasi digital yang sedang berkembang pesat di Indonesia khususnya di dalam pemberian pinjaman. Pinjaman online banyak memberikan manfaat dan kemudahan bagi masyarakat, di samping itu terdapat juga adanya permasalahan yang timbul di dalam pemberian pinjaman online di Indonesia seperti halnya penerapan transparansi dan akuntabilitas di dalam pemberian pinjaman online di Indonesia. Pinjaman Online di Indonesia telah diatur melalui Peraturan Otoritas Jakarta Nomor 77/POJK.01 Tahun 2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi, melalui POJK No. 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi telah memberikan pengaturan dan tata cara pelaksanaan bagi para pihak yang ada didalam Pinjaman Online. Pihak-pihak yang terdapat di dalam pinjaman online yaitu Penyelenggara, Pemberi Pinjaman, dan Penerima Pinjaman. Berbagai pengaturan yang mengatur mengenai Pinjaman Online baik itu dari segi pengaturan dan penerapan dengan melihat dari Prinsip Transparansi dan Akuntabilitas. Lembaga yang berwenang untuk melakukan pengawasan Pinjaman Online di Indonesia adalah Otoritas Jasa Keuangan. Meskipun masih ada beberapa perusahaan yang masih belum sepenuhnya menjalankan pengaturan yang di buat oleh OJK. Semestinya dalam hal penerapan pengaturan yang di buat OJK sudah cukup baik meskipun masih ada beberapa peraturan yang belum mengatur secara spesifik dalam perusahaan yang melakukan penerapan Prinsip Transparansi dan Akuntabilitas dalam Pemberian Pinjaman Online di Indonesia. Serta Sanksi Pidana yang dikenakan juga belum di rasa memberikan efek jera pagi para pemberi Pinjamam Online yang belum menerapkan Prinsip Transparansi dan Akuntabilitas di Indonesia sehingga perlu dilakukan peninjauan untuk melihat keselarasan atau harmoniasasi antara peraturan dan penerapan yang dilakukan baik oleh lembaga atau pihak- pihak terkait lainnya./ "According to the Central Statistics Agency (BPS), many people have lost their jobs due to the Covid-19 pandemic. So that people see online loans as an alternative way to fulfill their daily income and needs. By looking at the many people's enthusiasm for online loans, where online loans are a form of digital innovation that is growing rapidly in Indonesia, especially in lending. Online loans provide many benefits and conveniences for the community, in addition there are also problems that arise in the provision of online loans in Indonesia, such as the application of transparency and accountability in online lending in Indonesia. Online lending in Indonesia has been regulated through the Jakarta Authority Regulation Number 77/POJK.01 of 2016 concerning Information Technology-Based Borrowing-Lending Services, through POJK No. 77/POJK.01/2016 concerning Information Technology-Based Lending and Borrowing Services has provided arrangements and implementation procedures for the parties involved in Online Loans. The parties involved in online loans are the Provider, Lender, and Loan Recipient. Various arrangements that regulate Online Loans both in terms of regulation and implementation by looking at the Principles of Transparency and Accountability. The institution authorized to supervise Online Loans in Indonesia is the Financial Services Authority. Although there are still several companies that have not fully implemented the arrangements made by the OJK. In terms of implementing the regulations made by OJK, it should be quite good, although there are still some regulations that do not specifically regulate companies that implement the Transparency and Accountability Principles in Online Lending in Indonesia. As well as the criminal sanctions imposed have also not been felt to provide a deterrent effect for online lending providers who have not implemented the Principles of Transparency and Accountability in Indonesia, so it is necessary to conduct a review to see the harmony or harmonization between regulations and implementations carried out by institutions or other related parties"
