Abstract

Penelitian tesis ini berusaha untuk mengkaji dan menjawab dua permasalahan utama yang terkait dengan pengaturan hukum atau perundang-undangan tentang hak politik perempuan untuk dipilih dalam pemilihan legislatif untuk keanggotaan DPR di Indonesia dan implementasi dari peraturan perundang-undangan tersebut. Penelitian ini menggunakan pendekatan normatif, dan ciri utamanya adalah menggunakan bahan hukum primer, khususnya peraturan perundang-undangan terkait. Menggunakan pembelajaran dari hukum yang berlaku, buku, jurnal, tulisan, dan wawancara dengan pihak terkait. Dengan menggunakan teori The Idea Triad Gustav Radbruch dalam menjawab permasalahan pertama, ditemukan bahwa substansi undang-undang yang mengatur tema penelitian ini masih lemah, karena implementasinya belum maksimal. Belum mencapai gagasan hukum prioritas, yaitu keadilan. Teori keadilan bermartabat dari Teguh Prasetyo juga menjelaskan masalah kedua dan mendukung hasil penelitian dari masalah pertama. Dengan lemahnya peraturan perundang-undangan tersebut, maka implementasinya kurang optimal. Belum mampu memberikan keadilan sesuai dengan falsafah negara Indonesia yaitu Pancasila, khususnya bagi perempuan./This thesis research seeks to examine and answer two main problems related to the legal or statutory regulation of women's political rights to be elected in the legislative election for DPR membership in Indonesia and the implementation of these laws and regulations. The research uses a normative approach, and its principal characteristic is to use primary legal materials, especially related laws and regulations. It uses lessons learned from applicable laws, books, journals, writings, and interviews with related parties. Using Gustav Radbruch's The Idea Triad theory in answering the first problem, it was found that the substance in the law governing this research theme is still weak, as its implementation has not been maximized. It has not reached the priority legal idea, namely justice. Teori keadilan bermartabat from Teguh Prasetyo also explained the second problem and supported the research results from the first problem. With the weakness of these laws and regulations, their implementation is less than optimal. It has not been able to provide justice following the philosophy of the Indonesian state, namely Pancasila, especially for women.
