Abstract

Endorsement adalah teknik pemasaran modern dalam mempromosikan suatu produk barang atau jasa yang menggunakan jasa dari publik figur. Terlepas hal positif dari endorsement, nyatanya disalahgunakan untuk mempromosikan sesuatu yang bertentangan dengan kaidah dan norma hukum yakni promosi perjudian online. Perjudian adalah aktivitas yang dilarang oleh peraturan perundang- undangan dan mengalami transformasi menjadi perjudian yang menggunakan teknologi sistem informasi yang menjadi sarana dalam perjudian online. Barangsiapa yang melakukan segala bentuk kegiatan yang bermuatan atau mengandung unsur perjudian dapat dipertanggungjawabkan. Skripsi ini menggunakan metodologi pendekatan konsep (Conseptual Approach) dan pendekatan Undang – Undang (Statues Approach). Hasil pembahasan dalam Skripsi ini sesuai berdasarkan Undang – Undang Informasi dan Transaksi Elektronik serta Kitab Undang – Undang Hukum Pidana terkait penerapan pasal atas pertanggungjawaban pidana yang tepat terhadap publik figur yang melakukan endorse perjudian online. Penulis mengadaptasi kasus publik figur selebgram SM yang mempromosikan situs game slot judi online di akun instagramnya. Dalam penulisan ini membahasa tentang pertanggungjawaban pidana dan penerapan sanksi pidana menurut hukum pidana terhadap publik figur yang mempromosikan situs game slot judi online di media sosial/Endorsement is a modern marketing technique in promoting a product or service using the services of a public figure. Apart from the positives of endorsements, in fact it is misused to promote something that is contrary to legal rules and norms, namely the promotion of online gambling. Gambling is an activity that is prohibited by laws and regulations and undergoes a transformation into gambling using information system technology as a means of online gambling. Anyone who carries out any form of activity that contains or contains elements of gambling can be accounted for. This thesis used a conceptual approach and a status approach. The results of the discussion in this thesis are in accordance with the Information and Electronic Transactions Act and the Criminal Code regarding the application of the article on proper criminal liability against public figures who endorse online gambling. The author adapted the public case of an SM celebrity figure who promoted an online gambling slot game site on his Instagram account. This paper discusses criminal liability and the application of criminal sanctions according to criminal law against public figures who promote online gambling slot game sites on social media.
