Abstract

Penelitian ini Jaminan perlindungan hak-hak asasi ini juga penting pada perlindungan hak-hak konsumen. Pandemi Covid-19 di banyak negara telah membuka peluang bagi praktik-praktik bisnis yang tidak adil, menyesatkan, dan sangat merugikan konsumen, dengan efek merugikan lebih besar bagi kelompok konsumen rentan. Kasus dalam penelitian ini menyangkut penutupan pada kafe Holywings Kemang, Jakarta Selatan dikarenakan kerumunan yang terjadi pada hari Sabtu 4 September 2021, dan bertentangan dengan program pengendalian pandemi yang dilakukan oleh pemerintah daerah DKI Jakarta. Metode penelitian yang digunakan dalam penelitian ini adalah Yuridis Normatif. Pendekatan masalah yang digunakan dalam penelitian ini adalah berdasarkan statute approach yaitu pendekatan yang dilakukan dengan menelaah undang-undang dan regulasi yang bersangkut paut dengan isu hukum yang ditangani. Hasil penelitian menyebutkan akibat hukum Holiwings Kemang adalah penutupan sementara namun karena sudah sering melanggar aturan PPKM, serta tempat tersebut juga terancam denda Rp 50.000.000,- (lima puluh juta Rupiah). Hal itu bila mengacu pada Pasal 16 Paragraf 3 Pergub DKI Jakarta 3/2021. Ketentuan Pasal 9 UU HAM menjadi aturan dalam perlindungan konsumen dari penularan virus di tempat komersil, bahwa setiap orang berhak untuk hidup, mempertahankan hidup dan meningkatkan taraf kehidupannya. The Covid-19 pandemic in many countries has opened up opportunities for unfair, misleading, and very detrimental business practices to consumers, with greater detrimental effects for vulnerable consumer groups. The case in this study concerns the closure of the Holywings Kemang cafe, South Jakarta due to a crowd that occurred on Saturday 4 September 2021, and is contrary to the pandemic control program carried out by the DKI Jakarta regional government. The research method used in this research is normative juridical. The problem approach used in this research is based on the statute approach, which is an approach that is carried out by examining laws and regulations related to the legal issues being handled. The results of the study stated that the legal consequences of Holiwings Kemang were temporary closures, but because they had often violated the PPKM rules, and the place was also threatened with a fine of IDR 50,000,000 (fifty million Rupiah). This is when referring to Article 16 Paragraph 3 of the Governor of DKI Jakarta 3/2021. The provisions of Article 9 of the Human Rights Law become a rule in protecting consumers from virus transmission in commercial places, that everyone has the right to live, maintain life and improve their standard of living.
