Abstract

Pemerintah telah memberikan kesempatan kepada WNA untuk dapat memiliki Hak Pakai dan Hak Sewa untuk Bangunan di Indonesia, namun bagi WNA yang hendak melakukan investasi dalam bidang properti atau yang hendak melakukan kegiatan usaha menghendaki untuk dapat memiliki Hak Guna Bangunan di Indonesia yang dilakukan dengan cara membuat Perjanjian Nominee Arrangement di hadapan Notaris yang dituangkan dalam bentuk Akta Otentik. Sehingga diperlukan penelitian untuk mengetahui seberapa jauh tanggung jawab Notaris pada pembuatan Perjanjian Nominee Arrangement atas Tanah Hak Guna Bangunan oleh WNA dan untuk mengetahui akibat hukum Perjanjian Nominee Arrangement yang dibuat oleh Notaris pada Hak Guna Bangunan oleh WNA. Dalam melakukan penelitian ini, jenis penelitian yang digunakan ialah penelitian hukum normatif dengan menggunakan pendekatan undang-undang, pendekatan konseptual dan pendekatan kasus. Dari hasil penelitian tersebut, dapat disimpulkan bahwa dengan dibuatnya Perjanjian Nominee Arrangement yang berupa Akta Pernyataan dan Akta Pemberian Hak dan Kuasa di hadapan Notaris telah memindahkan Hak Guna Bangunan secara tidak langsung kepada WNA sehingga bertentangan dengan Pasal 36 UUPA, asas nasionalisme, asas larangan pengasingan Tanah dan Pasal 26 ayat (2) UUPA. Dengan demikian Notaris telah lalai melakukan kewenangan dan kewajibannya yang telah ditetapkan dalam UUJN sehingga sebagai bentuk pertanggungjawabannya Notaris dapat diberikan sanksi administratif. Selanjutnya oleh karena Perjanjian Nominee Arrangement yang dibuat di hadapan Notaris bertentangan dengan UUPA maka tidak memenuhi unsur sebab yang halal yang diatur dalam Pasal 1320 KUHPerdata yang mengakibatkan Perjanjian Nominee Arrangement batal demi hukum/The government has provided an opportunity for foreigners to have the Right to Use and the Right to Rent for Buildings in Indonesia, but for foreigners who want to invest in the property sector or who want to carry out business activities they want to be able to have a Right to Build in Indonesia which is done by making an Nominee Arrangement before a Notary which is set forth in the form of an Authentic Deed. So that research is needed to find out how far the Notary's responsibility is in making the Nominee Arrangement on Land with Building Use Rights by foreigners and to find out the legal consequences of the Nominee Arrangement made by Notaries on Building Use Rights by foreigners. In conducting this research, the type of research used is normative legal research using a legal approach, a conceptual approach and a case approach. From the results of this study, it can be concluded that by making a Nominee Arrangement in the form of a Deed of Statement and a Deed of Granting Rights and Powers before a Notary, it has transferred the Building Use Rights indirectly to foreigners so that it is contrary to Article 36 of the UUPA, the principle of nationalism, the principle of prohibiting the alienation of land and Article 26 paragraph (2) of the UUPA. Thus the Notary has neglected to carry out his authority and obligations as stipulated in the UUJN so that as a form of accountability the Notary can be given administrative sanctions. Furthermore, because the Nominee Arrangement made before a Notary is contrary to the UUPA, it does not fulfill the elements of a lawful cause as regulated in Article 1320 of the Civil Code which results in the Nominee Arrangement being null and void.
