Abstract

Notaris sebagai pejabat umum pembuat akta autentik memiliki tugas dan kewajiban untuk memberikan kepastian hukum kepada masyarakat. Dalam notaris melakukan tugas jabatannya perlu untuk berpedoman terhadap Undang-Undang Jabatan Notaris, baik Undang-Undang Jabatan Notaris yang lama, yaitu Undang-Undang Nomor 30 Tahun 2004 maupun Undang-Undang Jabatan Notaris yang baru, yaitu Undang-Undang Nomor 2 Tahun 2014 serta Kode Etik Notaris yang diatur dalam Perubahan Kode Etik Notaris Kongres Luar Biasa Ikatan Notaris Indonesia Banten, 29-30 Mei 2015. Ketika notaris menjalankan tugas jabatannya, terdapat Majelis Pengawas Notaris dan Dewan Kehormatan Notaris yang bertugas untuk melakukan pengawasan dan memberikan sanksi terhadap notaris yang terbukti melakukan pelanggaran terhadap Undang�Undang Jabatan Notaris dan Kode Etik Notaris. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan kasus, yaitu dengan menganalisa Putusan Kasasi Mahkamah Agung Nomor 2750 K/Pdt/2018 yang dikaitkan dengan Undang-Undang Jabatan Notaris dan Kode Etik Notaris. Dari hasil penelitian tersebut, dapat disimpulkan bahwa di dalam praktik masih terdapat notaris yang melakukan suatu perbuatan melawan hukum yang bertentangan dengan ketentuan didalam Undang-Undang Jabatan Notaris dan Kode Etik Notaris, serta belum tercapainya secara maksimal penegakan Undang-Undang Jabatan Notaris dan Kode Etik Notaris./ Notary as a public officer who has the power to make authentic deed, have a task and duty to give legal certainty to the public. Notary has to comply with the Notary Office Law, Law Number 30 year 2004 as amended by Law Number 2 year 2014, and the Notary Code of Ethics. Notary is supervised by the Notary Supervisory Board and Notary Honorary Council, who act as a supervisor and giving evaluation including punishment should the notary is proven of doing violation or non�compliance. In this research, data collection was carried out using a case approach, by analyzing Supreme Court Cassation Decision Number 2750/K/Pdt/2018 related to the law on Notary Office Law and the Notary Code of Ethics. From the observation, can be concluded that, there is notary doing the tort that is against the Notary Position Regulations and Notary Code of Conduct, and the maximum enforcement of the law on Notary Office Law and the Notary Code of Ethics has not been achieved.
