Abstract

Implementation of the Notary does not always run smoothly and without problems, there could be a dispute between the parties or error when signing outside the Notary jurisdiction area. Signing the act outside the jurisdiction area will cause a degradation in the strength of an Authentic Deed into a Private Deed, while it is signed by the parties. This caused those who feel aggrieved to report to the Police. In practice, often investigators calls a Notary for their statements without going through the procedures prescribed by the Notary Act No. 2 of 2014. In this study, collecting data and materials is done by using the approach of Regulations (Statute Approach) and Conceptual approach (Conceptual Approach), which means that this study analyzes regulations related to the calling procedure of Notary and the view of Notary Regulationss. From these results, it can be concluded that if a Notary being called by the police investigator, the investigator must first send a letter of request for approval to the Majelis Kehormatan Notaris Wilayah in the area of the Notary is located, in the form and content according to the rules prescribed by the Regulation of the Minister of Law and Human Rights No.7 in 2016. Majelis Kehormatan Notaris Wilayah then have 30 (thirty) days to decide whether to approve or deny the request, where before it was resolved, the Majelis Pemeriksa will be established to examine and take evidence from the concerned Notary. If found alleged criminal act according to those criteria in the Regulation of the Minster of Law and Human Rights No.7 in 2016, the approval will be given. / Pelaksanaan jabatan Notaris tidak selalu berjalan lancar dan tanpa masalah, bisa saja terjadi perselisihan di antara pihak atau kesalahan Notaris ketika menandatangani akta di luar wilayah jabatannya. Menandatangani akta di luar wilayah jabatan akan menyebabkan degradasi kekuatan akta tersebut dari Akta Otentik menjadi Akta di bawah tangan, selama masih di tandatangani para pihak. Hal ini meyebabkan pihak yang merasa dirugikan melapor ke Kepolisian. Dalam praktek, sering kali penyidik memanggil Notaris tersebut tanpa melalui prosedur yang telah ditentukan oleh Undang-Undang Jabatan Notaris Nomor 2 tahun 2014. Dalam penelitian ini, pengumpulan data dan bahan dilakukan dengan menggunakan pendekatan Perundang-undangan (Statute Approach) dan pendekatan Konseptual (Conceptual Approach), yang berarti penelitian ini menganalisa peraturan perundangan terkait prosedur pemanggilan Notaris dan pola pandang UndangUndang Jabatan Notaris. Dari hasil penelitian tersebut, dapat disimpulkan bahwa apabila seorang Notaris terpanggil oleh penyidik Kepolisian maka penyidik tersebut harus terlebih dahulu mengirimkan surat permintaan persetujuan kepada Majelis Kehormatan Notaris Wilayah di wilayah Notaris tersebut berada dengan bentuk dan isi sesuai aturan yang ditentukan oleh Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 7 tahun 2016. Majelis Kehormatan Notaris Wilayah kemudian memiliki waktu 30 (tiga puluh) hari untuk memutuskan menyetujui atau menolak permintaan tersebut dimana sebelum diputuskan, Majelis Pemeriksa akan dibentuk guna memeriksa dan mengambil keterangan dari Notaris bersangkutan. Jika ditemukan dugaan tindak pidana sesuai kriteria tersebut dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 7 tahun 2016 maka persetujuan akan diberikan.
