Abstract

Notary is the profession having the burden and greater responsibility that represent of countries in making tools evidence of deed and other duties determined legislation. As public officials, in carrying out notarial authority must be guided by the code of conduct and the legislation in force, which if breached could be penalized. Although there are regulations that restrict the behavior of a notary, but still found a notary who commits an offense as the writer have found in the High Court Decision of Yogyakarta No 84/PID/2014/PT YYK. Endang Murniati as notary in Sleman area has been found guilty of forgery against an authentic deed. Against the act of doing, the authors conclude that the deed of Notary Endang Murniati become null and void, so that the deed should be done by submitting an application through the cancellation of a civil lawsuit to Sleman District Court. In addition to already get a criminal charge of imprisonment, according to the Council of State Audit Notary authority may examine and decide upon the penalties to the notary, because the act of forgery also contain violations of the conduct and execution of the notary office. / d
