Abstract

This thesis entitled "Legal Certainty of Electronic Land Rights Certificate in Terms of Land Registration Regulations and State Administrative Law". The writing process uses a juridical normative method using a law approach and a theoretical concept approach. The things analyzed in the thesis writing are (1). How is the legal certainty of electronic land rights certificates viewed from the legal point of view of land registration and (2). How is the legal certainty of electronic land rights certificates viewed from the point of view of state administrative law. With legal research, it is concluded that in the formulation of the first problem, how from the legal point of view of land registration, the main reference is in Government Regulation Number 24 of 1997 concerning land registration, Minister of ATR/BPN Regulation Number 35 of 2016 concerning Acceleration of Complete Systematic Land Registration and Government Regulation Number 18 of 2021 concerning management rights, land rights, apartment units and land registration. Then the formulation of the second problem, how from the point of view of state administrative law, the main reference is Law Number 5 of 1986 Jo. Law No. 9 of 2004 plus government administrative law refers to Law no. 30 of 2014 concerning Government Administration. Electronic land certificate registration is regulated in such a way as the legal foundation for electronic land certificate registration in Indonesia / Tesis ini berjudul “Kepastian Hukum Sertipikat Hak Atas Tanah Elektronik Ditinjau dari Peraturan Pendaftaran Tanah dan Hukum Tata Usaha Negara”. Proses penulisan menggunakan normatif yuridis dengan menggunakan metode pendekatan undang-undang dan pendekatan konsep-teori. Yang dianalisa di dalam penulisan Tesis adalah (1). Bagaimana kepastian hukum sertipikat hak atas tanah elektronik ditinjau dari sudut pandang hukum pendaftaran tanah dan (2). Bagaimana kepastian hukum sertipikat hak atas tanah elektronik ditinjau dari sudut pandang hukum tata usaha negara. Dengan dilakukannya penelitian hukum maka didapatkan kesimpulan bahwa dalam rumusan masalah pertama bagaimana dari sisi sudut pandang hukum pendaftaran tanah, acuan utamanya berada pada Peraturan Pemerintah Nomor 24 tahun 1997 tentang pendaftaran tanah, Peraturan Menteri ATR/BPN Nomor 35 tahun 2016 tentang Percepatan Pelaksanaan Pendaftaran Tanah Sistematis Lengkap dan Peraturan Pemerintah Nomor 18 tahun 2021 tentang hak pengelolaan, hak atas tanah, satuan rumah susun dan pendaftaran tanah. Kemudian rumusan masalah kedua bagaimana dari sudut pandang hukum tata usaha negara, acuan utamanya adalah Undang-Undang Nomor 5 Tahun 1986 Jo. Undang-Undang Nomor 9 Tahun 2004 ditambah dengan hukum administrasi pemerintah mengacu pada Undang-Undang No. 30 tahun 2014 tentang Administrasi Pemerintahan. Pendaftaran sertipikat tanah elektronik diatur sedemikian rupa sebagai pondasi hukum pendaftaran sertipikat tanah elektronik di Indonesia.
