Abstract

Peralihan Hak Milik melalui jual beli harus dituangkan dalam Akta Jual Beli yang dibuat oleh PPAT sebab akta jual beli yang tidak dibuat oleh PPAT tidak dapat didaftarkan di Kantor Pertanahan. Hak Milik yang peralihannya telah didaftarkan dapat dibebankan Hak Tanggungan. Dalam penelitian ini, Penulis membahas dua permasalahan yakni Bagaimana peran dan tanggung jawab PPAT dalam peralihan hak milik yang diperjualbelikan? dan Bagaimana perlindungan hukum bagi pemegang hak tanggungan yang beritikad baik dalam hal proses peralihan hak milik yang diperjualbelikan cacat hukum? Hasil penelitian ini adalah pertama, peranan PPAT terlihat dari tugas dan kewenangannya dalam kegiatan pendaftaran tanah yakni dalam pembuatan akta jual beli yang kemudian didaftarkan ke Kantor Pertanahan. Atas peranan PPAT tersebut, PPAT memiliki 3 tanggung jawab yakni tanggung jawab administrasi, perdata, dan pidana. Kedua, dalam prakteknya, masih terdapat peralihan Hak Milik yang cacat hukum, yang kemudian mengakibatkan pembenanan Hak Tanggungan menjadi batal demi hukum. Oleh karena itu, pemegang Hak Tanggungan yang beritikad baik harus mendapatkan perlindungan hukum, berupa memperoleh tanggung jawab dari Debitor atau mengajukan gugatan secara perdata. Perlindungan hukum lainnya adalah memperoleh tanggung jawab dari PPAT dan membuat Pengaturan yang jelas terkait dengan eksekusi hak tanggungan/ Transfer of the Right of Land Ownership shall be written in the Trading Deed that made by Land Deed Official, because only by this, it can be registered at the Land Administrative Office and then it can be laden with Mortgage Right. In this study, the author will discuss two issues about How is the Land Deed Official role and responsibility in the Right of Land Ownership trading? And how is the legal protection for the good faithed Creditor in the Right of Land Ownership trading that hold legal defect. The results are, first, the role of Land Deed Official is his duty and authority in Land Registered as he makes the Right of Land Ownership trading Deed that will be registered at the Land Administrative Office. Land Deed Official has three responsibilities in administrative, civil, criminal. Second, there are still many Right of Land Ownership tradings that hold legal defect, that cause the Mortgage Right become null and void. Hence, good faithed Creditor must be legally protected by demand the Debtor’s responsibility or proposing lawsuit, or demand Land Deed Official’s responsibility, and set up the rules about Mortgage Right execution.
