Abstract

Kebutuhan kredit modal kerja pada debitur Bank terus bertambah, untuk mengantisipasi hal ini maka Bank akan memberikan tambahan kredit kepada debitur eksistingnya. Untuk mengetahui bagaimana pembebanan Hak Tanggungan pada sekumpulan fasilitas kredit yang terus bertumbuh khususnya untuk kredit komersial di perbankan, maka dilakukan penelitian analisis yuridis pembebanan Hak Tanggungan secara bertahap. Dalam penelitian ini, jenis penelitian yang digunakan adalah yuridis normatif. Sedangkan pengumpulan data dilakukan dengan penelitian kepustakaan dan penelitian lapangan melalui wawancara individual serta mengumpulkan data dari Legal Bank dan Notaris/PPAT. Dari hasil penelitian dapat disimpulkan bahwa apabila agunan yang dijaminkan masih mencukupi untuk diagunkan kembali, maka dapat dilakukan pengikatan Hak Tanggungan Peringkat Kedua, Ketiga dan seterusnya. Besarnya biaya Pendaftaran Hak Tanggungan yang ditetapkan untuk menjamin kredit diatas Rp. 10 Milyar, menyebabkan debitur meminta Bank untuk melakukan pembebanan Hak Tanggungan secara bertahap. Untuk mencegah tidak terpasangnya Hak Tanggungan maka Bank harus melakukan monitoring dan controlling terhadap pembebanan Hak Tanggungan yang dilakukan oleh notaris. Bank juga harus melakukan pengamanan dengan cara fasilitas pinjaman diblokir sejumlah pinjaman yang belum dilakukan pembebanan Hak Tanggungan dan diberikan covenant, yang mewajibkan debitur melakukan pembebanan Hak Tanggungan sampai seluruh kewajiban pendaftaran Hak Tanggungan selesai dilakukan / The need for working capital loans to the Bank's debtors continues to grow, to anticipate this, the Bank will provide additional credit to its existing debtors. To find out how the imposition of Underwriting Rights in a group of credit facilities that continues to grow, especially for commercial loans in banks, a research and juridical analysis is carried out in stages. In this study, the type of research used is normative juridical. Data collection is done by library research and field research through individual interviews and collecting data from the Legal Bank and Notary / PPAT. From the results of the study it can be concluded that if the collateral that is pledged is still sufficient to be re-pledged, then it can be binding on the Second, Third Rank Mortgage Rights and so on. The amount of the mortgage fee registration fee is set to guarantee credit above Rp. 10 billion, causing the debtor to ask the Bank to gradually charge the Mortgage. To prevent the non-installation of Mortgage Rights, the Bank must monitor and control the imposition of Mortgage Rights by a notary public. The bank must also provide security by means of the loan facility being blocked by a number of loans that have not yet been encumbered and given a covenant, which requires the debtor to charge the Mortgage right until all obligations for registration of the Mortgage Right have been completed
