Abstract

Hak sewa dapat diartikan bahwa seseorang atau badan hukum dapat menggunakan hak milik tanah atau bangunan orang lain dengan adanya perjanjian sewa menyewa dengan membayar uang sewa yang sudah disepakati. Notaris sebagai pejabat umum berwenang untuk membuat akta otentik dan bertanggung jawab atas segala akta yang dibuat oleh notaris. Landasan Teori dalam penelitian ini terdiri dari tinjauan umum tentang tanggung jawab, perikatan, perbuatan melawan hukum, perjanjian sewa menyewa, notaris serta memliki landasan konseptual dalam proses pembuatan akta perjanjian sewa menyewa. Metode Penelitan yang digunakan dalam penelitian ini adalah penelitian hukum normatif – empiris dengan menggunakan data-data sekunder seperti dokumen-dokumen resmi, buku-buku, hasil-hasil penelitian yang berwujud laporan, buku harian dan seterusnya. Teknik pengumpulan data yang mendukung dan berkaitan dengan penelitian ini adalah studi kepustakaan dan wawancara dengan melakukan pendekatan penelitian undang-undang KUHPerdata dan Undang-Undang Jabatan Notaris serta pendekatan kasus dalam Studi Kasus 2155K/PDT?2020. Penelitian ini dianalisis dengan analisis kualitatif yang bahan dari analisis ini diperoleh dipisahkan menurut kategori masing-masing dan diberi tafsiran secara abstraktif guna menjawab permasalahan yang sudah dirumuskan. Analisa dalam penelitian ini dapat diuraikan bahwa kabsahan dari hak sewa perjanjian sewa menyewa yang dilakukan oleh notaris tidak sah dikarenakan salah satu pihak telah melanggar Pasal 1559 KUHPerdata dimana dijelaskan bahwa sebagai penyewa, jika tidak diizinkan oleh pemilik sejati tidak boleh menyalahgunakan barang-barang yang disewanya atau melepaskan sewanya kepada orang lain. Dalam penelitian ini dapat dikatakan bahwa notaris lalai dalam menjalankan tugas jabatannya dikarenakan notaris tidak teliti dan tidak menerapkan prinsip kehati-hatian yang menimbulkan perbuatan melawan hukum bagi kedua belah pihak. Dalam hal ini notaris dapat saja dimintakan pertanggung jawabannya dan dapat dikenakan sanksi. / Rights of lease can be interpreted that a person or a legal entity can have the rights to use other people’s land or building with a rent agreement by paying rent fee due to what have been agreed. Notary as a public official is authorized to create supporting documents that legally enforce such as contracts; of which as a notary is legally responsible for. The theoretical basis in this study consists of an overview of responsibilities, obligations, tort of law, rent agreement, notary dan have a conceptual basis ini the process of making a rent agreement deed. The research method used in this research is normative – empirical legal research by using secondary data such as official documents, book, research result in the form of reports, diaries ad so on. This research techniques is by collecting data which supports and relates to this research such as literature studies and interviews by doing a research to the Civil Code Law and on the rules of notary professesion as well as a case approach on Case Study 2155K/PDT/2020. This research was analyzed by qualitative analysis in which is obtained that they are separated according to their respective categories and given an abstraction in order to answer the problems that have been been formulated. The analysis in this study can be explain that the validity of the rental rights of the rent agreement carried out by a notary is invalid because one of the parties has violated Article 1559 of the Civil Code Law, where it is explained that as a person who rents, it is not permitted by the true owner, you may not misuse the rented good or release the rental right to someone else. In this study, it can be said that the notary is negligent in carrying out his duties because the notary is careless and does not apply the precautionary principle which cause tort of law or unlawful acts for both parties. In this case the notary may be held his/her responsibilities and may be penalized.
