Abstract

Notaris sebagai pejabat dalam menjalankan profesi wajib mengikuti ketentuan undang-undang yang berlaku. Adapun demikian notaris memiliki kewajiban untuk melakukan tatap muka secara langsung dengan para penghadap untuk melakukan penandatangan akta namun pada Era Disrupsi ini membuat tatanan hidup manusia mulai berubah termasuk pada profesi notaris sebagaimana dalam menjalankan profesinya dituntut untuk mengikut zaman. Pada era ini manusia telah memasuki keadaan serba digital yang juga mempengaruhi pada profesi notaris yang dimana hal ini makin diperkuat dengan munculnya pandemi Covid-19 yang menuntut kita untuk melakukan segala hal dari rumah melalui sistem informasi dan teknologi yang ada. Rumusan masalah pada penelitian ini membahas tentang bagaimana Implikasi Hukum terhadap Tatap Muka Notaris dengan Para Penghadap di Era Disrupsi Serta Penyesuaian Pada Keadaan Covid-19 dan bagaimana solusi hukum atas tanda tangan digital pada akta notaris. Metode yang digunakan dalam penelitian ini adalah metode penelitian normatif-empiris dengan menggunakan pendekatan perundang-undangan dengan mengkombinasi pendekatan historis. Teknik perolehan data dengan cara bahan pustaka serta wawancara dengan teknik Purposive Sampling. Dari hasil penelitian dapat disimpulkan bahwa tidak adanya penyesuaian yang dilakukan pemerintah terhadap UUJN atas tatap muka yang dilakukan Notaris dengan Para Penghadap serta hasil penelitian pada solusi hukum atas tanda tangan digital pada akta notaris adalah dengan dibentuknya suatu sistem untuk keberlangsungan cyber notary di Indonesia serta menyelenggarakan lembaga sertifikasi tersendiri untuk menopang berjalannya tanda tangan digital pada akta notaris./Notary as officials in carrying out their profession are required to follow the provisions of the applicable laws. However, in this Disruption Era, the order of human life began to change, including the notary profession as in carrying out its profession it is required to keep up with the times. In this era, humans have entered an all-digital state which also affects the notary profession, which is further strengthened by the emergence of the Covid-19 pandemic which requires us to do everything from home through existing information systems and technology. The formulation of the problem in this study discusses is how the legal implications of face-to-face notary in the era of disruption and adjustment to the Covid-19 situation are and how the legal solutions for digital signatures on notarial deeds. The method used in this research is a normative-empirical and research method using a statutory approach by combining a historical approach. The technique of obtaining data by means of library materials and interviews with purposive sampling technique. From the results of the study, it can be concluded that there is no adjustment made by the government to the UUJN on face-to-face contact by a Notary with the Appraisers and the results of research on legal solutions for digital signatures on a notary deed is the establishment of a system for the sustainability of cyber notary in Indonesia and organizing institutions separate certification to support the digital signature on the notary deed.
